Joshua Trindall: Dubbo man spared conviction for drunken acts

An ‘ashamed’ drunk who abused his mother and punched holes in walls after she tipped his drink down the sink has been spared convictions in court.

A Dubbo teen who started drinking at 8am one day and lashed out at his mother and stepfather while he was blind drunk in the afternoon has been spared convictions in court.

Joshua Aaron Trindall’s shameful behaviour was detailed after he appeared in Dubbo Local Court to be sentenced for breaching an apprehended domestic violence order (ADVO) twice, intimidating family members twice and damaging property.

In court documents police said the 19-year-old was at his mother’s house in Armidale on January 27 when she returned home for lunch and found him sitting on the lounge with a glass of bourbon and coke.

After the pair had a heated argument about Trindall’s drinking habits, the mother picked up her son’s drink and poured it down the sink.

In a state of extraordinary anger, he punched a hole in the wall and walked to the garage where he put his first through another wall.

When Trindall left the house a neighbour had to intervene to calm him down after he persistently banged on the front door.

Police attended, arrested Trindall and took him to the police station where he confessed to downing six glasses of Jim Beam and Cola between 8am and 2.20pm when he was apprehended for the wall punching.

After he was charged with property damage, Trindall was given bail and had an ADVO slapped on him but it did not deter him from going back to his mother’s house for a second attack.

Police said at 6pm he arrived back at the home and abused his mother because she tipped his drink down the sink.

According to police, Mr Trindall called his mother a “mother f*****, c**k s****r and c***” before he tried to pull a security screen off a window.

When his stepfather asked him to leave, Trindall, who was visiting Armidale from his former home in Kempsey, told his stepdad to “get out on the road” because he wanted a fight.

After Trindall’s stepdad had more abuse hurled at him, he took matters into his own hands and hit Trindall in the face.

Police charged Trindall with a string of offences including breaching an ADVO, damaging property and intimidating his mother.

He pleaded guilty and in court defence lawyer Lucy Maher said at the time of the drunken rampage, Trindall was drinking alcohol everyday.

“He has cut back … the road to recovery is not a straight one,” she said.

“At the time of the offending he had lost both of his grandmothers. He used alcohol as an emotional crutch … Mr Trindall is incredibly ashamed of this offending and embarrassed.”

“He also had experienced the breakdown of a long-term relationship and is a person who until these offences, had a good relationship with his mother.”

The court heard Trindall had no criminal history, was in the process of attempting to repair the broken relationship with his mother and had sought professional support from Headspace.

Magistrate Theresa Hamilton said Trindall was entitled to a more lenient sentence because he pleaded guilty early, had a good record and was cooperative with police.

“He was punched and left the premises,” she said.

“He has provided a reference from his uncle who has taken him under his wing.

“The defendant deserves the opportunity to not have a conviction on his history.”

Trindall was sentenced to a 12-month conditional release order with no conviction recorded.

“You need to understand if there’s any further offending you could be brought back and convicted and re-sentenced,” Magistrate Hamilton warned Trindall.

“You need to stay out of trouble.

“The main problem you need to address is alcohol abuse.”
