A 27-year-old Dubbo man has been spared a conviction after he headbutted another man in Dubbo’s CBD.

Jarryn Powyer pleaded guilty to one count of assault occasioning actual bodily harm when he faced Dubbo Local Court on Wednesday.

According to an agreed facts statement tendered in court, the former Dubbo CYMS captain-coach had been drinking alcohol at the Castlereagh Hotel when he headbutted fellow rugby league player Nicholas Wright and caused his nose to bleed on August 29.

Defence lawyer Jai Silkman told the court Mr Powyer committed the act of violence after he saw his partner walking out on the street with Mr Wright.

“He completely accepts the way he reacted was wrong,” Mr Silkman said.

“He is at a bit of a loss to explain why he reacted the way he did. It’s another example of alcohol-fuelled violence.”

A day after the assault, Mr Wright reported Mr Powyer to police and his version of events was backed up by another prominent local footy player, Isaac Thompson, who provided a statement to police in St Marys.

Mr Silkman told the court if Mr Powyer received a conviction it would potentially be detrimental to his work as a highly respected public school teacher in Dubbo.

“He tells me he’s had four sessions of counselling and wishes to continue with that after today.

“He’s immediately stepped down from his position at the football club.”

Magistrate Gary Wilson said Mr Powyer was a role model who was very highly spoken of.

“It’s totally out of character and something you would never have reverted to in the past,” he said.

Magistrate Wilson sentenced Mr Powyer to a nine-month conditional release order and recorded no conviction.

“You only get one of these,” magistrate Wilson warned.
