A grub who attacked a woman with a cricket bat and dragged her across the road by her hair two days after he got out of jail has made a shocking claim in a bid to downplay his crimes.

A man who used a cricket bat to savagely attack a woman he repeatedly punched, grabbed by the hair and dragged across a main Dubbo road into oncoming traffic cried in court as he tried to minimise the extent of the injuries he inflicted.

Repeat domestic violence offender Gavin Kevin Weldon had only been released from jail for two days when he launched an unprovoked attack on the woman in her home.

In court documents, police said the 38-year-old Riverstone resident started arguing with the woman in her loungeroom before he grabbed a cricket bat and hit her legs with it.

When she tried to call for help, Weldon took the woman’s phone and said “before you leave anywhere, me anywhere or you anywhere, I’ll kill you, you slut”.

The woman left the home and was followed along the street by Weldon.

A member of the public called police after they saw the pair at the intersection of Braun Avenue and Myall Street.

Police said while on the street Weldon grabbed a handful of the woman’s hair and “marched her across the road in front of oncoming traffic”.

He punched the woman three times in the face and when she tried to pull away, Weldon grabbed the woman again by the hair and dragged her off the road.

On a vacant block of land, Weldon threw the woman to the ground and punched her in the head and torso.

When police arrived they saw Weldon throw a kitchen knife into a neighbour’s yard.

“No assault happened, we were just arguing,” Weldon told police.

“I just got out, you’re not telling them I assaulted you are you,” he said to the woman who was taken to Dubbo Base Hospital for treatment.

Weldon wept in Dubbo Local Court when he appeared via audiovisual link and entered pleas of guilty to intimidation, assault occasioning actual bodily harm and AVO breach charges.

“I did hit her with a bat, there was no bruising, there were no marks to her leg,” Weldon said in court.

The court heard Weldon witnessed domestic violence as a child and started using heroin at age 14 to block out bad feelings.

Weldon switched to ice in 2015 and was disgusted with himself, the court heard.

Magistrate Gary Wilson convicted Weldon and sentenced him to two years and three months in jail.

“You were only released two days before the offending and you are straight back into it with the same complainant,” Magistrate Wilson told Weldon, who will be eligible for parole in January 2023.
