Prosecutors have withdrawn a murder charge against one of two men who had been arrested over the stabbing death of George John Kirk at Dubbo last year.
Daniel Fitton, 30, faced Dubbo Local Court on Thursday via audiovisual link from Sydney where he heard the murder charge was being dropped.
He is still facing other charges including aggravated entering a dwelling, stalking and intimidation and accessory after the fact to murder.
The Campbeltown man was arrested in October 2023, for allegedly being involved in the fatal stabbing of Mr Kirk just after 12am on August 16 inside a home on Margaret Cres, Dubbo.
When emergency services arrived, they found the 39-year-old suffering stab wounds to his chest – he died at the scene.
Mark Peckham, 40, was also charged with murder and remains before the courts.
It is alleged the pair went to the home in search of methylamphetamine.
Fitton has also pleaded not guilty to a stalk and intimidation in relation to a domestic violence offence.
His three other charges of aggravated entering a dwelling, stalking and intimidation and accessory after the fact to murder have been certified.
His then-partner Stevie-Lee Jordan has also been charged with accessory after the fact to murder, intending to pervert the course of justice and hindering a serious investigation after she allegedly lied to police about the murder.
Fitton was granted NSW Supreme Court bail on July 16 after his applications to both Liverpool and Dubbo courts were refused last year.
His matter will return to court October 17.
