Bourbah: Alleged drink driver allegedly killed quad bike driver

A man accused of killing a quad bike rider in a crash with his utility allegedly blew five times over the legal limit, a court has heard.
Warren resident David Francis Gall, 63, appeared via a visual audio link before Dubbo Local Court on Monday, when he was refused bail for allegedly killing Paul Kelly while drink driving on Gulargambone Rd in Bourbah.
The two-vehicle collision occurred between 4.45pm and 5pm on Friday, 58km southwest of Coonamble.
After Gall contacted the police for assistance, he allegedly recorded 0.274 on a roadside breath test.
Police prosecutor Ben Bragger’s submissions stated that the charges were “very serious … someone is dead”.
“The concern is that he will commit further traffic offences, endanger more lives and endanger the community,” Mr Bragger told the court.
“Nevertheless, concerns for community safety is a paramount reason for the bail to be refused.’’
Gall has been charged with dangerous driving occasioning in death and negligent driving occasioning in death.
Mr Bragger told the court Gall would be charged with additional offences.
Requesting the approval of his bail application, solicitor Naadirah Sathar said Gall had “strong community ties” with a “limited” history of drink driving offences.
“There is a question about when he had those drinks,” Ms Sathar said.
Magistrate Debra Maher opposed Gall’s bail application because there was a “lot of unanswered questions” in the matter.
“The concern is the risk to the community if Mr Gall is to get behind the wheel of a car,” Ms Maher said.
“On more than one occasion he has got behind the wheel of a car when he has had alcohol.
“Bail will be refused — too great of a risk to the community.”
