A Dubbo man who sought to scare his wife by holding a knife to his throat, pleaded guilty to one charge of domestic violence related common assault on Wednesday.

Alex Sudeep, 39, appeared in Dubbo Local Court after he was arrested on March 20, 2021 for the assault.

Documents tendered to court reveal that after the victim arrived home from work at around 11.20pm the pair were involved in an argument when Sudeep “pushed the victim on the side of the head with an open palm” in an angry outburst.

The victim was upset and left the room to contact the police and later told Sudeep about the call, which made him angrier.

“The accused has gone into the kitchen and grabbed a kitchen knife,” agreed facts state.

“(Sudeep)... put the knife to his throat and said ‘if police come, I’ll do it’. This caused the victim to be fearful of the (his) actions.”

A short time later, police attended the address of the couple and were greeted by a “panicked and distressed victim”.

She told police not to come inside due to Sudeep holding a knife to his throat and threatening to hurt himself.

Officers proceeded to go inside the house when Sudeep came out of the bedroom without a knife, however police found it under the bed.

Sudeep was placed under arrest where he admitted to pushing the victim in the head, but said he did not mean to hurt her.

When taken to the police vehicle, Sudeep said he had no intentions of using the knife on the victim, instead he wanted “to scare her”.

He was conveyed to Dubbo Police Station and placed into custody.

The court heard from Sudeep’s lawyer, Jai Silkman, that he has been attending a psychologist to address his mental health problems which were related to the matter, which was “significantly out of character”.

He appealed to Magistrate Gary Wilson to proceed with a sentence without conviction, and referenced Sudeep’s clean record.

The police prosecutor opposed the submissions, describing the incident as “an emotionally manipulative and blackmailing effort”, and calling for a conviction.

He questioned whether Sudeep, who holds a position as a nurse, should be working in “that type of industry”.

Mr Wilson accepted Mr Silkman’s submissions, handing Sudeep a conditional release order without conviction for 12 months.
