A Macquarie Park real estate agent has been warned he will go to jail if he is found driving without a licence for the fourth time, a court has heard.

Ho Wu, 33, appeared before Downing Centre Local Court on Tuesday after being caught driving with a cancelled licence that was previously disqualified for six months.

Agreed police facts tendered to the court state Mr Wu was driving a blue Mazda 6 sedan on Mitchell Rd, Alexandria about 5.10pm on October 9 when he was stopped by police for roadside testing.

“Upon request to produce his current drivers licence the accused stated ‘I only have a photo of it’,” agreed police facts stated.

“He then produced a digital photograph of a NSW drivers licence in the accused’s name on his mobile phone. The photograph depicted that of the accused.”

A check of the licence revealed it was cancelled from July 14, 2022 after a 6 month period of disqualification ordered by Castlereagh Local Court dated from January 13, 2022.

In court, Mr Wu’s solicitor said his client had worked in real estate for six years and alleged he was responding to a work inquiry when he was pulled over by police.

Magistrate Rebecca Hosking told the court that this was Mr Wu’s third offence of this nature before proceeding to sentencing.

“Your record does not assist you … you have shown an absolute disregard for our state’s licensing system” Magistrate Hosking said.

“Sir, just last week I put someone in custody who was up to the fourth, fifth, so I mean it when I say you are on the cusp of this.

“Next time it will be a jail cell.”

Mr Wu pleaded guilty to driving with a cancelled licence and was given a 12 month community corrections order, a $2200 fine and was disqualified from driving for 12 months.
