Pair charged over Potts Point brawl appear in court after weekend carnage

He was supposed to ensure responsible alcohol consumption, instead, police allege an RSA marshall became involved in a violent booze-fuelled brawl that saw officers left with concussion.

An RSA marshall who allegedly came to the aid of family members involved in a wild Potts Point brawl with police has been slammed by a magistrate.

Daniel Malupo, 31, has been released on bail after being arrested when he presented to Kings Cross police station on Wednesday, charged with several offences following the melee on October 19.

The Brighton Le Sands resident is the fifth person charged over the incident that left five police officers in hospital with injuries including a dislocated jaw, torn bicep, chipped elbow and concussion.

He is charged with three counts of assault police, three counts of hinder police, and one count of affray, conceal serious indictable offence and carry on security without a license.

At Central Local Court on Thursday Magistrate Margaret Quinn had little sympathy for the accused, despite his alleged “limited” role, saying the injuries suffered by police were “dreadful”.

“No matter who your family is … you should know better,” she said. “What a disgrace.”

Police will allege Malupo was working at the Flamingo Lounge, when a brawl erupted outside the venue between police and several members of his family about 11.20pm.

During the struggle the court heard Malupo began “dragging” officers off his family members yelling “Get off him, don’t hurt him”.

The court heard the 31-year-old had an acquired brain injury as a result of a serious car accident in 2010, a trauma that hinders his decision making.

Magistrate Quinn was short in her response: “If he can’t control his emotions he shouldn’t be working in these places”.

His co-accused Maria Usaia’s alleged role in the night of mayhem began on the street where she is accused of assaulting two Kings Cross cops, causing actual bodily harm to one, and leaving three others to fear for their safety in the melee.

The 22-year-old from Airds is alleged to have continued her rowdy behaviour in the cop shop, where she allegedly damaged a cell while in custody.

She has been charged with affray, two counts of assaulting a police officer and one each of assaulting an officer and causing actual bodily harm and property damage.

Usaia appeared briefly in the Downing Centre Local Court supported by her family today and is due back on October 31.

Malupo will appear before Central Local Court again on November 7.
