Andrew Dadley: Fire chief allegedly raped woman while she slept

A female firefighter has told how she thought she was dreaming when she allegedly woke to find a senior fire chief raping her. He is accused of twice raping the woman after a Christmas party.

A female firefighter thought she was dreaming when she allegedly woke to find a senior fire chief raping her at a Sydney unit, a court has heard.

Andrew Thomas Dadley is accused of twice raping the woman and indecently assaulting her after a night of drinking at a staff Christmas party in 2016.

Dadley, who rose to the rank of superintendent at Fire and Rescue NSW’s former Alexandria training college, has “no idea” where the allegations came from and pleaded not guilty to two counts of sexual intercourse without consent and one of committing an act of indecency as his District Court trial began on Wednesday.

The 44-year-old had been invited to stay at the woman’s apartment along with another colleague after the party ended about midnight on December 9, 2016.

Speaking to the jury, Crown prosecutor Tarik Abdulhak said the woman prepared two beds and the lounge, one spot for each person staying over, and they all retired separately after sharing a nightcap.

She soon passed out in her bed, having drunk 12 beers and three spirits during the night, but allegedly woke to find herself naked with Dadley on top of her at about 3am or 3.30am.

“The next thing she realised the accused was having sex with her,” Mr Abdulhak told the court.

Dadley is alleged to have scooped the woman up and taken her to the bed he was meant to be sleeping in before again starting to have sex with her, while she was still in a “dreamlike state”.

It was when she opened an eye and allegedly saw the Wahroonga man “licking his fingers” and touching her intimate areas that she snapped out of the trance, the court heard.

“Eventually she realised she was not dreaming and kicked off the accused,” Mr Abdulhak said.

The woman allegedly began slapping Dadley in the face, who is said to have replied: “Why are you hitting me?”

She then dragged Dadley by his hair to the front door and forced him outside, the court heard.

Defence barrister Matthew Johnston said the nature of his client’s exit was not in dispute, but Dadley denied any sexual activity or contact took place before.

“His case is simple, he went to bed,” he said. “The next thing he knew he woke up to (the woman) hitting him. He had no idea why that happened. He caught an Uber home to his wife.”

Mr Johnston said DNA found in the alleged victim’s vaginal cavity, which the court heard matched the profile of Dadley, could have been transferred via contact with his client’s clothes or hair.

DNA could be transferred between two people “simply by shaking a hand”, he told the jury.

The trial continues.
