A 22-year-old woman has told a court she didn’t believe she assaulted an officer when she allegedly struggled violently as two police tried to handcuff her.

Indya Selbie faced Gosford Local Court on Monday charged with assaulting police, resisting arrest and negligent driving.

It came after Brisbane Water police were attending a break and enter about 7am on Sunday at Ocean View Drive at Wamberal when a Holden Astra collided with the rear of a parked car nearby.

The officers went to the scene to check on the welfare of the female driver, Ms Selbie, who was breath tested and returned a negative result.

Ms Selbie was arrested and informed she would be taken to Gosford Hospital for mandatory drug testing.

Police allege she violently struggled with both officers as they were attempting to handcuff her.

Additional police attended and the woman was restrained before being placed into the police vehicle and taken to hospital.

A leading senior constable was treated at Gosford Hospital for a knee and elbow injury and has since been discharged.

Ms Selbie was later taken to Gosford Police Station and charged with assaulting police, resisting police and negligent driving.

Representing herself in court Ms Selbie said she chose not to speak to a Legal Aid solicitor.

When asked if she would be pleading guilty or not guilty Ms Selbie said: “I don’t believe I’m guilty of assaulting a police officer”.

The court heard she had a Queensland driver’s licence and she said her Burleigh Heads address listed on her licence was her father’s home.

She told the court she could live with a friend at Toukley.

Magistrate Alan Railton granted her bail on the condition she report to Toukley Police daily and inform the officer-in-charge of her new address within 48 hours.

Mr Railton also told her to speak to Legal Aid before her next court appearance.

“The facts here being alleged against you are serious,” he said.

Police are still awaiting the results of the mandatory drug tests.
