Tessa Morgan sentenced for ongoing supply of prohibited drugs

A mother of two, who was breaking Covid rules when she was pulled over in Somersby, has been sentenced for ongoing supply of methylamphetamine.

A mother of two who has been sentenced over the ongoing supply of drugs was caught in Somersby while breaking Covid regulations.

Tessa Morgan, of Telarah, was sentenced to a two year Intensive Corrections Order (ICO) on Friday at Gosford Local Court before Magistrate Jennifer Price,

An ICO is the equivalent to a jail term served in the community.

Ms Morgan, who was visibly upset as the sentence was handed down, pleaded guilty to a charge of supplying prohibited drugs on an ongoing basis over a three-day period in July 2021 and hindering an investigation on July 25. Another four supply charges were withdrawn.

A set of agreed facts tendered to the court state that Ms Morgan, accompanied by a male passenger, was pulled over by police in Somersby on the afternoon of July 25 2021 driving a silver BMW.

“Enquiries revealed that the accused and co-accused were in breach of current Public Health Orders related to the Covid-19 pandemic,” the facts stated.

Police arrested the male passenger of the vehicle who was allegedly in possession of $14,000.

The facts state that Ms Morgan hid the man’s mobile phone in her clothing during a search of the vehicle and was caught out when the phone started to ring.

Ms Morgan’s handbag was also searched with a notepad inside revealing handwritten notes with names and dollar amounts corresponding to weights of methylamphetamine.

Her mobile phone was also seized and further investigations revealed messages in relation to the supply of methylamphetamine.

“It was established that the accused uses text messages, Facebook messenger and encrypted messaging services to facilitate her drug supply activities,” the facts stated. “The Accused primarily sells street level deals ranging between 0.1g to 3.5g.”

The facts state that on July 23, she had a conversation with a man for the supply of “hlf oz”, 14g of methylamphetamine, for $5000.

The next day she did a deal with the same man for 3.5g for $1500.

The facts indicate she also did two deals on July 21 including a “g” for $500 where she told her client “it’s real good”

Ms Morgan’s defence lawyer said the mother of two did not have a criminal record with her actions “out of character” and an “aberration”. He said her drug use spiralled after a traumatic event in her life and she started associating with people in the drug scene.

“She began supplying drugs to the people in this circle,” he said.

He described the supply of methamphetamine as “relatively small, street level|”amounts which funded her habit.

“She is deeply remorseful and embarrassed by her actions,” he said.

Magistrate Price said Ms Morgan supplied a total amount of 19g of methylamphetamine.

“Your actions have caused a significant amount of drugs to be unleashed to the community,” she said to Ms Morgan.

She said she was astounded that Ms Morgan, with no criminal record” would come before the court with “such serious offences”.

When handing down her two year ICO, Magistrate Price said “specific deterrence looms large” along with protection of the community.

Ms Morgan was also given 100 hours of community service.
