Shane Smith: Rock thrower caught on dashcam at Chittaway faces court

Dashcam footage of an ice addict armed with half a brick, who smashed a driver’s window, has gone viral. But you won’t believe how he behaved back at the police station after his arrest.

An ice addict who armed himself with a bucket full of half bricks thought the “Army was out to get him” when he started throwing them at passing cars, a court has heard.

Shane Smith appeared via video link at Wyong Local Court on Monday where he was polite to the magistrate and looked calm.

It was a far cry from how he appeared in dashcam footage posted on social media after the 33-year-old smashed the driver’s side window of a car, which stopped when he approached the vehicle in the middle of the street.

A set of agreed facts state he continued his foul language and obscene behaviour back at Wyong Police Station after his arrest.

Smith’s Legal Aid solicitor applied for bail, telling the court he was “delusional at the time” having been “up for days” on ice.

“He believed the Army was out to get him,” she said.

Smith pleaded guilty to destroying three car windows shortly after 6pm on Friday, affray and throwing a missile at police.

He also pleaded guilty to intimidating two police officers, threatening to burn one officer’s house down and urinating in the police cells after his arrest.

Smith urinated in the cells at Wyong Police Station.

His Legal Aid solicitor told the court the floor and wall tiler could live at his rented accommodation at Glenning Valley, abide by strict bail conditions and attend the MERIT drug program.

However bail was formally refused.

The agreed facts state about 6pm on Friday Smith was walking the streets in the vicinity of Platypus Drive, Berkeley Vale, when he “armed himself with a bucket of half bricks and brick sized rocks”.

About 6.12pm a motorist observed him to the right of her Nissan X-Trail.

As she turned left into James Watt Drive, at Chittaway, he threw a half brick to the driver’s side window causing it to “immediately shatter”.

About a minute later a woman was driving a silver Ford Fiesta along James Watt Drive when he threw a brick, smashing her windscreen and yelled at her “Do you want a war, do you f***n want a war”.

About three minutes later another motorist was driving her Mazda 3 along James Watt Drive when he approached that vehicle yelling that he had a gun on him.

The driver reversed to get away and put his window up as the driver was “afraid the accused was going to hit him”.

“The accused lunged at his vehicle with the rock in his hand smashing [his] window,” the facts state.

About 6.18pm Smith approached some people in the front yard of a nearby property where he told them “I’ve got a gun and I’ll blow your head off”.

About 6.20pm when police arrived he threw a half brick at the police vehicle which “narrowly missed”.

“Police exited the police vehicle and tackled the accused to the ground before he could arm himself with further missiles,” the facts state.

Back at Wyong Police Station he began yelling at the custody manager to “come on sergeant three striper, you f’n dog man” and “I’ve done 20 years c..t I can flog you” while punching the dock door.

When a female officer came into the charge room he said “I want to root you. I love you” while grabbing his crotch.

At 7.36pm he bent over in his underpants yelling at her to come and smack his buttocks.

The facts state he asked her “Did you want to see me wanking like a dog” while making a motion with his hand before exposing himself.

“Have a look at this. Look at my flaccid cock,” he told her.

Then he yelled at the custody sergeant “I’m gonna burn your f’n home down. F... your wife, you old prick, you f’n paedophile. I’m gonna f... your wife then f... your sister, burn your f’n home paedophile dog”.

Later he calls the female officer a “fat slut”, a “f’n stripper slut” and tells her to shoot him.

“The accused then urinated in the dock and yelled at [the female officer] `smell this hot piss you dyke c..t, you stitched me up you dyke. I will piss on you because you stitched me up. I’ll follow you around all day you f’n bitch I will piss on your head,” the facts state.

The dock was unusable until police could arrange for a “forensic clean”.

Smith was adjourned to April 30 for sentence.
