A man has narrowly avoided a full-time custodial sentence after spitting in the face of a McDonald’s manager after she refused to give him free food.
Adam Michael O’Callaghan represented himself when he faced Wyong Local Court after pleading guilty to failing to wear a face mask inside a restaurant during lockdown, common assault and intimidation.
He also pleaded guilty to breaching community correction orders he was on at the time for having goods in custody; resisting an officer in the execution of their duty and not complying with a reasonable direction.
The court heard the 38-year-old from Berkeley Vale had a “lengthy criminal record” in both NSW and Western Australia.
“The accused is a regular at the location for abusing staff in order to get free food and is well known by employees at the location,” the facts state.
About 6.30pm on Saturday, June 26, O’Callaghan entered the McDonald’s restaurant at Mingara wearing a black Kathmandu jacket.
“The accused has distinctive tattoos on his neck and hands which are clearly visible on CCTV footage,” the facts state.
“The accused is wearing a mask around his neck however at no point in time throughout the incident did the accused wear any fitted face covering as per the public health order. At the time of the offence the Central Coast was currently under a stay at home order.”
O’Callaghan approached the food counter and told staff they had stuffed up his order and he did not get what he paid for.
He became aggressive and was yelling at staff when a female manager approached and said she would review the CCTV footage.
The manager came back to the front counter and advised him the footage shows he had, in fact, not paid for anything.
“The accused leant over the counter about 30cm from the victim’s face, continued to yell and point at the victim in an intimidating manner,” the facts state.
The manager again advised O’Callaghan he needed to pay for the food he wanted.
“The accused continued to yell at the victim before coughing up phlegm, leaning around the plastic sheeting and spitting in the victim’s face, causing saliva to go into the victim’s eyes and face,” the facts state.
“The accused then left the premises on his scooter before yelling at the victim `just you wait and see what I’m going to do to you, I will come for you’.”
Police were called and reviewed the CCTV and identified O’Callaghan.
About 10.30am on July 1 O’Callaghan attended Wyong Police Station — wearing the same black Kathmandu jacket worn in the footage — where he was charged.
“The accused was remorseful for his action stating he does not remember everything that occurred on the night due to a mix up in medication,” the facts state.
O’Callaghan was convicted and fined $200 for failing to wear a mask, a further $500 for spitting in the manager’s face and placed on an intensive corrections order for nine months for intimidation.
