The husband of a Tuggerah Lakes police officer has pleaded guilty to a number of offences after he tried to make it appear his wife’s lover had sent emails containing videos of them having sex.
Matthew Brett Boyd, 32, of Summerland Point, was charged with nine offences following his wife’s affair with a police colleague in 2018.
He pleaded guilty to four charges at Wyong Local Court this week including making false accusations subject to an investigation; hacking his wife’s social media accounts; knowingly provide misleading information regarding police conduct and intimidation.
One charge of intentionally distributing an image without consent and four charges of accessing restricted data in a computer were withdrawn and dismissed.
An agreed statement of facts, tendered in court, states Mr Boyd’s wife Constable Nicole Boyd “had an extramarital relationship” with Senior Constable Kevin Riboldi three months after she started working at Wyong Police Station.
“During their relationship she and Riboldi exchanged messages, videos and photos and messages via email and the applications (`apps’) Snapchat, WhatsApp and Keepsafe,” the facts read.
“On 27 November 2018 Nicole Boyd and the victim (Mr Riboldi) consensually recorded two videos (The Intimate Videos) depicting intimate sexual acts between them inside the spare bedroom in the Boyd (home).”
On Boxing Day 2018 Sen Const. Riboldi woke up to find that he had missed calls and messages from Const. Boyd in the early hours of the morning.
She sent him WhatsApp messages at 3.48am and 4.09am telling him that her husband knew about their affair.
“Don’t write back but he has found out,” she wrote.
“He’s hacked my Snapchat and read everything. I’ve told him we haven’t slept together.”
Later that day they met at Charlestown Shopping Centre and Sen Const. Riboldi recommend she take out an apprehended violence order (AVO) but she declined.
“Well if he’s going to come after me and try something stupid, then I’ll apply for my own AVO that you would be covered under and you wouldn’t be able to talk me out of it,” Sen Const. Riboldi told her.
Throughout the day she sent Sen Const. Riboldi messages saying she wanted to be with him.
But at 10.45pm she messaged him: “I’m sorry Kev, I’m ending our relationship tonight …. If you truly love me you’ll respect my decision and not contact me again. I’ve spoken to Matt and told him we have slept together.”
The next day Mr Boyd sent a message to Sen Const. Riboldi but he did not get it until months later when he installed Facebook Messenger on his phone for unrelated purposes.
“You’ve got the balls to tell my wife you love her but have you got the balls to face me and tell me or are you going to keep sneaking around behind my back like the dog you are?” the message read.
On New Year’s Day 2019 Mr Boyd left two voicemails on Sen Const. Riboldi’s mobile phone.
One was muffled but in the other message he told him: “Don’t be a pussy. Ring me. Man up you f***ing dog.”
The next day Mr Boyd sent Sen Const. Riboldi a text telling him not to contact his wife ever again, “not make eye contact or even speak her name”.
“If we ever come face to face then you better pray to whoever it is you pray to and run as fast as you can,” the text read.
The facts state Mr Boyd sent his wife an email with a screenshot showing how he had managed to access her Keepsafe app where the intimate videos were stored and changed her password.
On January 6, 2019, Mr Boyd created a fictitious Gmail account and doctored up an email so it appeared it had originally been sent by Sen Const. Riboldi’s private email address and had been forwarded on a couple of times.
The subject of the email was “Enjoy” and the intimate videos were attached.
He forwarded this email to his wife who was at work at the time.
She believed Sen Const. Riboldi had sent them to her husband to harass her.
Const. Boyd spoke to her sergeant on the phone who told her to come back to the station and she filled out an AVO against Sen Const. Riboldi.
He was working a night shift and shortly after midnight was brought in to the station and told about the AVO.
“The victim was shocked and said: `I was going to apply for my own order against him”. He read the grounds of the AVO and said: `I didn’t do this, I’ve been set up’,” the facts read.
Sen Const. Riboldi was stood down from his duties on January 7, 2019.
In his police interview Mr Boyd said he received the email and instantly recognised his wife’s face when he opened one of the attachments.
“The male was sitting on a bed and her face was down between his legs,” he told police.
He said he opened the second attachment and saw two people having sex.
“I recognised Nicole was one of these people from the Chinese symbol tattoo on her stomach.”
However police were able to trace the origin of the email to the fake Gmail account Mr Boyd had set up and he was charged with making false accusations subject to an investigation and knowingly provide misleading information regarding police conduct.
Sen Const. Riboldi was cleared of any wrongdoing and the AVO against him was eventually withdrawn on July 15 at Gosford Local Court.
Mr Boyd will be sentenced on July 21.
