Police officers Nicole Boyd and Kevin Riboldi’s affair ends in conviction for husband Matt Boyd

A husband — angry over discovering his police officer wife’s affair with another cop on the Central Coast — has been sentenced after he faked emails containing videos of the pair having sex to frame his wife’s lover, a court has heard.

When Matthew Brett Boyd found out his police Constable wife Nicole was having an affair with another Tuggerah Lakes officer he set about driving a wedge between them, a court has heard.

The 32-year-old from Summerland Point was sentenced at Wyong Local Court on Tuesday after pleading guilty to four offences including making a false accusation to police, hacking his wife’s social media accounts to commit a serious offence, knowingly providing misleading information regarding an officer’s conduct and intimidation.

One charge of intentionally distributing an image without consent and four charges of accessing restricted data in a computer were withdrawn and dismissed.

An agreed statement of facts, tendered in court, states Mr Boyd’s wife, Constable Nicole Boyd, “had an extramarital relationship” with Senior Constable Kevin Riboldi three months after she started working at Wyong Police Station.

“During their relationship she and Riboldi exchanged messages, videos and photos and messages via email and the applications (`apps’) Snapchat, WhatsApp and Keepsafe,” the facts read.

“On 27 November 2018 Nicole Boyd and the victim (Mr Riboldi) consensually recorded two videos (The Intimate Videos) depicting intimate sexual acts between them inside the spare bedroom in the Boyd (home).”

The court heard Boyd learned of his wife’s affair on Christmas Day 2018 and later accessed her Keepsafe app where he discovered the videos.

On January 6, 2019, Boyd created a fictitious Gmail account and doctored up an email so it appeared it had originally been sent by Sen Const. Riboldi’s private email address and had been forwarded on a couple of times.

The subject of the email was “Enjoy” and the intimate videos were attached.

He forwarded this email to his wife who was at work at the time.

Tuggerah Lakes Police commenced an investigation and Sen Const. Riboldi was stood down with pay on January 7, 2019.

In his police interview Boyd said he received the email and instantly recognised his wife’s face when he opened one of the attachments.

“The male was sitting on a bed and her face was down between his legs,” he told police.

He said he opened the second attachment and saw two people having sex.

“I recognised Nicole was one of these people from the Chinese symbol tattoo on her stomach.”

However, police were able to trace the origin of the email to the fake Gmail account Boyd had set up and he was charged with making false accusations subject to an investigation and knowingly provide misleading information regarding police conduct.

He was also charged with intimidation over a series of threatening voicemails he left on Sen Const. Riboldi’s phone.

Crown Prosecutor Sally Stuart told the court over the course of about a week Boyd “acted with malice” in a “campaign against the victim” and that he had time to “contemplate the criminality” of his offending.

She said Sen Const. Riboldi was stood down on his birthday, which “adds insult to injury” and that police took out an interim apprehended violence order against him for the protection of Const. Boyd.

This AVO was eventually withdrawn seven months later and Sen Const. Riboldi was cleared of any wrongdoing.

Ms Stuart said Boyd’s false accusations were offences against the victim and the legal system, which involved a “waste of police resources”.

However Boyd’s solicitor Marc Riviere said he was upset about the affair and tried to make his wife “dislike” Sen Const. Riboldi by convincing her that the officer had sent the videos of them having sex.

He said he was remorseful of his actions but once he had made the false accusations could not bring himself to tell his police officer wife.

“He took a step and then he could not step back from it,” Mr Riviere said.

He said Boyd believed he had to convince Mrs Boyd that Sen Const. Riboldi had sent the videos “or lose his wife”.

The court heard the couple remained married and have since had their third child in February.

Magistrate Elizabeth Ellis said Const. Boyd and Sen Const. Riboldi’s decision to have an extra marital affair triggered Mr Boyd’s course of offending.

“To a degree all three have some kind of culpability that has landed (the matter) in court today,” she said.

However Ms Ellis said she was not there to judge Const. Boyd or the victim who must have suffered stress “on a professional and personal level”.

She sentenced Boyd to four community corrections orders for a total of two years with supervision.

She also ordered he undertake 200 hours of community service.
