A man has been jailed for posting a picture online of his ex-wife’s sister giving him oral sex with the caption “Wife cheats on me. Her sister sucks my c*** haha”.
Father-of-two Peter Farrawell-Smith sat with his head bowed as the sentence was handed down, with his girlfriend crying by his side.
The heavily tattooed 35-year-old started messaging his wife’s sister after they split up.
Farrawell-Smith, from Gosford, then secretly recorded her performing oral sex on him before posting it to Snapchat.
The victim was confronted by her sister, Mr Farrawell-Smith’s ex wife, who then reported the incident to police.
Jailing him at Gosford Local Court, Magistrate Alan Railton described the offence as “just nasty” and said actions like this won’t be tolerated in the community.
“It’s a nasty offence, a degrading offence, an absolute gross breach of trust,” he said.
“He has photographed her performing intimate acts without her knowledge.”
The court facts state when Mr Farrawell-Smith split up with his wife, he started messaging her sister over Snapchat asking her to have sex.
They ended up meeting up at his house in Eagle Vale in March and April 2019.
“On one occasion the accused secretly video recorded the victim performing oral sex on him,” the facts read. “The victim was unaware of the video recording.”
Facts state the pair met up again in April and Mr Farrawell-Smith video recorded oral sex and sexual intercourse.
The victim stopped going to his house, despite ongoing invitations throughout May, June and July.
“The accused has then posted an image of the victim performing fellatio upon him on his Snapchat account … with a comment ‘Wife cheats on me. Her sister sucks my c*** haha’,” the facts state.
The victim was confronted by her sister, Mr Farrawell-Smith’s ex wife, and reported the incident to police.
The facts state Mr Farrawell-Smith’s ex wife also confronted him and he not only showed her the images but “readily admitted” to recording them without her knowledge. He was arrested in November 2019.
Mr Farrawell-Smith’s defence indicated he had a rough childhood and was remorseful for his actions, also noting his girlfriend had a child on the way.
Magistrate Railton said the offence was new to the Crimes Act to reflect available new technology such as mobile phones.
“It’s become so prevalent in the community, penalties at the higher end have to be used to send a message to those who may do further actions of exploiting innocent people in situations,” he said.
“The message has to be sent loud and clear to the community that this will not be tolerated.”
Magistrate Railton said the case was also concerning as Mr Farrawell-Smith was already on a Community Corrections Order for intimidation towards his ex wife.
Mr Farrawell-Smith was sentenced to six months jail and given a community corrections order for 18 months.
Mr Farrawell-Smith has since appealed the decision and been released on bail. His appeal hearing will be held on March 3 at Gosford District Court.
