A father of three carried out a violent act of “retribution” after coincidentally spotting a woman who had stolen cash from his home.
Patrick James Graham pleaded guilty to wounding a person with intent to cause grievous bodily harm, destroying or damaging property, and driving recklessly, furiously, or at a speed or in a manner dangerous.
He was sentenced to jail in the Gosford District Court on Wednesday.
The court heard that on September 25, 2023, the victim entered Graham’s home while he and his partner were asleep and stole cash and wallets. The incident was captured on Graham’s CCTV.
Amy Holt, who was 41 at the time of the offence, was jailed for 20 months on May 9, 2024 at the District Court in Sydney on the charges of aggravated entering a dwelling, attempt to dishonestly obtain property by deception and larceny.
On October 10, 2023, at 8am, Graham was driving when he spotted the victim in her car. He did a U-turn near North Lakes Tavern and began following her.
He continued to follow her until she pulled into Wills Rd, San Remo. Graham then got out of his vehicle with a long metal screwdriver and struck the victim’s car window, causing it to shatter.
Witnesses heard Graham shouting, “I’ll kill you, I’ll f--king kill you” and “you’ve broken into my house, you c--t”.
The court heard that he then struck the victim through the broken window, hitting her arms and head before changing his grip and stabbing and spearing her with the screwdriver. The victim eventually managed to drive away.
As she attempted to flee, Graham used his car to ram the driver’s side door of her vehicle. Witnesses saw the victim bleeding from the head and heard her screaming and crying.
The court heard Graham’s partner called the police to report the incident. Graham remained at the scene until officers arrived, while the victim drove away to hide.
She was later taken to Gosford Hospital by ambulance, where she was treated for a scalp haematoma, a puncture wound to her tricep, and bruising to her arms and head.
Graham was arrested at his home on October 12 2023.
When cautioned by police he said: “At the end of the day, if you guys had done your f--king job, how would I have crossed paths with this person?”
He also told police he had not been looking for a violent confrontation.
Judge Tanya Bright described the attack as “an offence of significant violence directed towards the victim”.
“I accept the initial motivation of the offender may have been to follow the victim so she could be identified before police,” she said. “However, after her vehicle stops, his motivation is clearly retribution for the alleged offending by the victim, having regard to his words used at the time.”
Graham was sentenced to an aggregate term of three years and three months in jail, backdated to 12 October 2023. He will be eligible for parole on 11 May 2025.
