Central Coast: Woman, who identifies as male, slapped partner for calling him a rapist

A woman, who identifies as a man, has been jailed after sexually assaulting his partner and then slapping her across the face — while she was holding a baby — after she called him a rapist.

A woman, who identifies as a man, has been sentenced in court after pleading guilty to sexually assaulting his partner and then slapping her across the face — while she was holding a baby — when she called him a rapist.

The offender, who cannot be named for legal reasons, was sentenced at the Gosford District Court on Friday after pleading guilty to sexual intercourse without consent and common assault.

The offender was sentenced to a total of two years and nine months jail.

An agreed set of facts states the woman, aged in his 20s who identifies as a man, was in an “off and on” relationship with another woman who had children from a previous relationship.

The court heard the couple separated in early 2023 when the offender was sentenced to 10-weeks in custody for an unrelated incident but resumed their relationship after his release.

However during their time apart the victim became pregnant and gave birth in early 2024 after they had resumed their relationship.

Three months later the victim had a routine check up with her doctor and told the offender she had no interest in sex.

They arranged a movie night and organised babysitters for the victim’s children when they lay down for a nap.

The offender started rubbing the victim’s leg and the victim pushed his hand away, telling him she didn’t feel comfortable.

The offender said “don’t be silly” and picked up a purple vibrator.

The victim said “it will hurt” but the offender said “I’ll be soft”.

The victim tried to throw the vibrator away but the offender grabbed her hands and held them above her head before sexually assaulting her as the woman “froze” in shock.

The following day the offender started packing up his things and said he wanted to leave.

“The victim said ‘do you want to leave as you’re a rapist?’,” the facts state.

“The offender slapped the victim across the face while the victim was holding the baby.”

The victim put the baby down, told the offender to leave and rang police.

Giving evidence the offender said he accepted the victim was vulnerable because she was holding a baby at the time.

“I never intended to hurt her, it was just a reaction, right,” he said.

“And straight away afterwards I felt bad for her.

“I understand the nature of this crime and the seriousness of it and I understand what I have done.”

The court heard that the victim felt as though “all this was my fault” and was angry at herself.

“I always wonder if what happened to myself was my fault,” the victim said.

In her sentencing remarks, Judge Tanya Bright said “the victim bears no responsibility whatsoever, that responsibility falls solely and heavily upon the offender”.

“The offender completely disregarded the consent of the victim for his own sexual gratification.

“Sexual offending has serious consequences for victims as it undermines their sense of safety,” she said.

The offender will be eligible for parole on January 21, 2026.
