Long Jetty: Man run over by his partner wants AVO changed so they can rekindle relationship

A man, who was run over by his partner after an argument, has applied to have his name removed from a restraining order so they can rekindle their relationship, a court has heard.

A man who was allegedly run over by his partner in a fit of rage has applied to a court to have his name removed from an apprehended violence order.

The 42-year-old woman, who cannot be named for legal reasons, represented herself in Wyong Local Court on Tuesday where she is facing six charges including dangerous driving occasioning grievous bodily harm – drive manner dangerous, drive recklessly/furiously or speed/manner dangerous, fail to stop and assist after impact cause injury, common assault (domestic violence-related) and two counts of drive motor vehicle during disqualification period.

Her former partner, 36, also appeared in court where he applied to have his name removed from an apprehended violence order (AV0) that was taken out by police following the alleged incident.

The interim AVO names the man and his children as people in need of protection and bans the woman from having any contact with them other than through a lawyer.

The man told the court his children now lived with their mother in Sydney and by having his name removed from the AVO it would allow the woman and him to resume their relationship without breaching any court order.

However Magistrate Stephen Olischlager said the safety and protection of the children was “paramount” and far outweighed his desire to “rekindle your relationship”.

Magistrate Olischlager said there was no evidence before the court, such as a Family Law Court order, to confirm the children would have to remain in Sydney.

He said the new arrangement “could change tomorrow” and the children end up back living with their father.

Magistrate Olischlager refused the application to remove the man’s name and adjourned the matter to June 13.

Charge sheets tendered in court allege the man and woman had a verbal argument at a home at Long Jetty about 11pm on February 21.

Police will allege the woman then drove a Toyota Prado towards the man, who was carrying a 10-month-old child, hitting them both.

The woman took the injured child to The Entrance Police Station where he was treated by NSW Ambulance paramedics for head and facial injuries before being taken to Gosford Hospital in a stable condition.

The woman was taken to Gosford Hospital for testing before she was taken to Gosford Police Station where she was charged with six offences.

Her conditional bail was continued.
