Hamlyn Terrace: Senior Constable Andrew Martin granted bail over alleged domestic violence incident

A Senior Constable has been banned from holding a gun after appearing in court charged with the alleged domestic assault of a woman, who has since moved interstate, a court has heard.

The alleged victim of a domestic violence incident involving an off-duty Senior Constable has moved interstate to live with family, a court has heard.

Andrew Martin, of Hamlyn Terrace, appeared in the dock at Wyong Local Court on Tuesday after spending the night in police cells at Wyong Police Station.

The 27-year-old Senior Constable was arrested about 7pm on Monday and taken to Wyong Police Station where he was charged with three counts of common assault and one count of intimidation.

Martin, who was attached to a command in the North West Metropolitan Region, was represented by a Legal Aid solicitor who successfully applied for bail.

His solicitor told the court Martin “denies the charges” and may be represented by a private solicitor, provided by his employer’s union, at the next occasion.

The solicitor told the court the complainant had since moved interstate to live with family and there was no possibility Martin was at risk of committing any further offences.

The police prosecutor opposed bail and while the magistrate said there were “valid concerns” any risks to the community could be mitigated by strict conditions.

The prosecutor asked that one of those conditions, given Martin’s profession, be that he was not permitted to handle a firearm for any reason.

Magistrate Stephen Olischlager granted bail with the conditions that Martin live at an address in Hamlyn Terrace and that he not handle a gun.

He was adjourned to face court again on June 8.

Charge sheets tendered to court allege Martin assaulted a woman once about 8am on May 23 and two more times about 4pm on the same day.

He is also alleged to have intimidated the woman on the same afternoon.

A statement from NSW Police said Martin’s employment status was under review.
