A lecherous boss who grabbed a female employee almost half his age on the bum and sent her explicit messages via Facebook has been sentenced to 150 hours of community service.

But Jason Evans, of Irving Court Hamlyn Terrace, denied exposing his penis to her or touching her elsewhere.

The 48-year-old faced Wyong Local Court this morning after pleading guilty to one count of assault with an act of indecency.

An agreed set of facts revealed Evans, a married man with children, was the regional manager of a recruitment firm for people with disabilities who had a 27-year-old woman reporting directly to him.

In May last year the woman was injured in a non-work related incident and was working from home.

On June 13, 2018, Evans rang her and arranged to come to her home and later arrived about 1.115pm with a six pack of Strongbow cider.

After working for a while the pair had a drink on her back veranda.

When she got up to go to the toilet Evans “grabbed her on the buttocks with his hand” to which she replied “don’t”.

He left some time later telling her he would see her the next day before she texted a friend of hers to tell her what happened.

She eventually summonsed the courage to go to police and he was formally interviewed on June 25.

He admitted he “smacked” the woman’s buttocks and that he did not have her permission to do so.

“The accused denied touching (the victim) in any other intimate place or exposing his penis to her,” the police facts read.

“The accused stated that (the victim) had been present during a conversation about circumcision during which the accused had disclosed information about his penis.

“The accused admitted that he had sent explicit messages to (the victim) via Facebook Messenger.”

Magistrate Elizabeth Ellis convicted Evans and put him on a Community Corrections Order for two years.

As part of the bond Ms Ellis ordered he also undertake 150 hours of community service.

The court heard he was still working.

Evans’ Linkedin profile states he left his role with the disability recruitment company in June — the same month as he was interviewed by police — and now purports to work for another disability employment service provider AimBig.

Ms Ellis asked rhetorically whether the incident was just a one-off big “oops” or whether it was “the first of many and a pattern of behaviour”.

“And thank your partner who is in court with you today for continuing to support you, many wouldn’t,” Ms Ellis said.
