Lake Munmorah: Michael James Wells pleads guilty to the crash that killed Yasemin Osman

A driver involved in a fatal smash was showing off his Subaru WRX to a mate when he ploughed into a Toyota Landcruiser on the Central Coast, killing a young mother.

A man has pleaded guilty to a fatal crash at Lake Munmorah, which claimed the life of a beautiful young woman.

Michael James Wells, of Lake Munmorah, faced Wyong Local Court on Tuesday — almost a year to the day after the horrific collision.

He formally entered pleas of guilty to negligent driving occasioning death, causing harm by misconduct and aggravated dangerous driving occasioning death while speeding more than 45km/h.

Two other charges of dangerous driving occasioning death were withdrawn and dismissed.

Facts tendered in court state the 34-year-old met up with a mate at Lake Haven Shopping Centre on October 16 last year and agreed to take him for a ride in his Subaru WRX Impreza sedan — with the registration plates “5HMICK” — because his friend was considering buying a Subaru.

They left the shopping centre about 8pm and did a U-turn at Kangaroo Rd before Wells turned to his mate and said “we’ll go fast” and adjusted a dial on the centre console to “sport mode”.

Wells and his mate were travelling west along the Pacific Highway at speed when they came to the intersection of Colongra Bay Rd, where 29-year-old Yasemin Osman, from Doonside, was turning right into the road from the highway.

Wells’ car slammed into Ms Osman’s vehicle and shunted it with such force the 4WD wrapped around a concrete power pole leaving her with fatal “extensive head and pelvic injuries”, the facts sate.

An investigation by a specialist officer from the Crash Investigation Unit found Wells started braking two seconds before the impact and hit Ms Osman’s vehicle while travelling at between 84-86km/h.

However the investigation found just before braking Wells was travelling at 138km/h and was 112m away when Ms Osman began to make the turn into Colongra Bay Rd.

“The Landcruiser needed no more than an extra 0.42 seconds to successfully negotiate the right-hand turn,” the facts state.

“Had the Subaru been approaching at the signposted speed limit when the driver of the Landcruiser committed the turn, there would have been more than sufficient time for the Landcruiser to successfully negotiate the turn and avoid the collision.”

A number of witnesses attended the scene and saw Wells and his mate climb out of the Subaru through a side window.

One bystander saw Ms Osman’s five-month-old baby in a capsule in the rear seat and smashed the back window to unclip the infant who was uninjured.

Ms Osman was declared dead at the scene.

Wells was taken to John Hunter Hospital where he returned negative results to alcohol or drugs.

He was arrested and charged two days later.

Wells was adjourned to face Gosford District Court on November 18 to fix a date for his sentencing and his bail was continued.
