Joshua MacMillan refused bail over alleged high-range drink-driving crash at Umina

An alleged drink-driver who blew 0.18 after allegedly doing a burnout in an unregistered Holden Commodore before crashing into a car, has faced court.

An alleged drink-driver, who went up onto a footpath and crashed into another car after losing control doing a burnout, was so drunk he had no idea how serious the alleged incident was, telling officers “f..k what have I even done, no one is dead”, a court has heard.

Dressed in a grey hoodie and blue boardshorts a dishevelled Joshua MacMillan faced Gosford Local Court on Friday charged with a raft of traffic offences and assaulting police.

It came after police were called shortly before 7pm on Thursday to West St near Bullion St, Umina following reports a Holden Commodore and Toyota Camry had collided.

As a result of the impact, the Toyota came to a stop on West Street damaging the front of a business. A third vehicle parked nearby was also damaged.

The driver of the Toyota, a 42-year-old man, was treated at the scene before being taken to Gosford Hospital with non-life-threatening injuries. His two passengers, aged 18 and 12, were not injured.

Mr MacMillan, who was allegedly driving the Holden, was assessed at the scene by paramedics.

The 30-year-old then allegedly became aggressive towards police, pushing an officer before he was arrested.

He was taken to Woy Woy Police Station where he allegedly returned a breath analysis reading of 0.180.

His Legal Aid solicitor applied for bail, telling the court the 30-year-old had a “significant gap” since a previous high range drink-driving offence in 2011.

“He’s had some significant trauma in the last week, his friend had died of a stroke,” she said.

The solicitor told Mr MacMillan would be willing to abide by strict bail conditions that he report daily to police, abstain from dugs or alcohol and not occupy the driver’s seat of any vehicle.

Magistrate Alan Railton said it “appeared to be a very strong prosecution case” with CCTV footage of the alleged incident.

He said the police facts indicated he had driven up onto the footpath before colliding with the other car, that he did not have his headlights on despite it being dark and he “had no appreciation” of the severity of the situation.

Magistrate Railton said it was particularly concerning that he was so affected by alcohol when he was in the back of the ambulance Mr MacMillan told police “f..k, what have I even done, no one is dead”.

Mr MacMillan was charged with drive with high-range PCA, assault police officer in execution of duty, interfere with persons enjoyment or risk safety, unlawfully possess number plates, not comply P1 licence — no P plates, use class A vehicle with unauthorised number plate affixed, use unregistered registrable class A motor vehicle on road, and drive recklessly/furiously or speed manger dangerous.

Charge sheets tendered in court allege the registration plates on the Holden did not belong to that vehicle.

Magistrate Railton refused Mr MacMillan bail to reappear on August 26.
