A Hamlyn Terrace man who vowed to stay away from “alcohol and bad friends” when he was jailed in 2021 has appeared in court twice within a 24 hour period.
Hayden Champion, 25, appeared at Wyong Local Court on Tuesday over charges of aggravated robbery with an offensive weapon and common assault.
Police allege that the night of April 10 and 11, Champion robbed a man of his car using a hammer at Norah Head before assaulting him.
The court heard Champion was on parole until December 2022 for previous convictions of assault and affray in 2021.
Champion’s lawyer Samantha McKenzie applied for his bail to be varied so he could live with his mother. She said Champion felt unsafe in his current rehabilitation facility with other people in the program taking “ice”.
Magistrate Kirralee Perry said given Champion’s history of violence, she was “not comfortable releasing him into the community”.
“Your record is terrible,” she told Champion. “You were on parole when you allegedly committed these offences.”
However, she granted the variation due to safety concerns ordering Champion to live with his mum on home-detention, saying “if you come back before me you will be bail refused”.
Champion appeared back in Wyong Local Court less than 24 hours later as a fresh custody in the dock with Magistrate Perry saying “I did tell you not to come and see me again”.
The court heard Champion went to Hamlyn Terrace on Tuesday afternoon after court to find police at his mum’s house to arrest him.
He was charged with five domestic violence related offences including stalk/intimidate, steal, common assault and destroy damage property.
The court heard the charges related to an alleged incident on Monday in Hamlyn Terrace.
“The facts state that you were on ice,” Magistrate Perry said.
Champion had a different defence lawyer who applied for his release saying he had been accepted at a facility in Newcastle and had been making significant efforts to rehabilitate himself from drugs.
He also stated that these were his first domestic violence related offences.
Magistrate Perry said Champion was non compliant when it came to parole as well as bail conditions.
She also noted that Hayden complained about people in his rehabilitation facility on “ice” and then was alleged to have been under the influence of ice on Monday.
Bail was refused and Hayden’s lawyer entered pleas of not guilty to the domestic violence related offences. He is yet to enter pleas to the alleged robbery offence.
As he was taken back into custody, Hayden called out “I love you mum”.
Hayden was released from jail earlier this year after being convicted of common assault and affray in 2021.
The conviction related to a Doyalson party he attended where he punched a woman who threatened to send his girlfriend videos of them kissing at a party. His actions sparked a massive brawl which saw Champion stabbed. During his sentence he vowed to “start a new chapter” on release.
Hayden’s recent matters will be mentioned again in August.
