Three men will be sentenced for their roles in the assault of a man, 64, who tried to help them when the car they were travelling in slammed into a parked caravan more than two years ago.
Standing side-by-side in the dock, Reece Nathan Gaul and Rydge Liam Wynen appeared at Gosford District Court on Tuesday where they were arraigned on two fresh indictments.
The men, aged in their early 20s, had each been charged with causing grievous bodily harm and three counts of assault occasioning actual bodily harm in company.
They were supposed to begin a two-week trial on Monday after pleading not guilty to the four charges but were re-arraigned on Tuesday following negotiations.
Gaul pleaded guilty to causing grievous bodily harm and affray while Wynen pleaded guilty to a single count of assault occasioning actual bodily harm.
A third man, Kayne Allen, was also supposed to face trial on Monday after initially pleading not guilty to the same four charges as his co-accuseds.
However he faced court on Friday where the Crown prosecutor accepted a plea offer and Allen was re-arraigned, which saw him admit to causing grievous bodily harm and affray.
It comes a little over two years since the trio were passengers in a Toyota Corolla allegedly being driven by a 17-year-old P-plater who crashed into a parked caravan on Skyhawk Ave, at Hamlyn Terrace, about 10.15pm on August 27, 2022.
Rob Seddon, then aged 64, his adult son Kyle Seddon and two other men, went to assist after hearing the car crash outside.
The driver was trapped in the wreckage.
Mr Seddon, who was trained in first aid, his son and the two other men were set upon by Gaul, Wynen and Allen when they approached the car to help.
Mr Seddon was knocked unconscious and left in a critical condition when he fell backwards and smacked his head into the pavement.
He was flown to John Hunter Hospital where he underwent emergency surgery to relieve the pressure from his brain.
Mr Seddon spent months in and out of hospital following the incident and remains in a wheelchair with a significant brain injury.
Kyle Seddon and the two other men were punched with one of the victims, aged 21 at the time, suffering a broken nose.
Gaul, Wynen and Allen fled the scene before police arrived.
The teenage driver of the Corolla underwent a breath analysis, which returned a reading of 0.025.
He was later charged with driving with a special range prescribed concentration of alcohol, having non-compliant tyres and negligent driving.
His provisional driver’s licence was suspended but there was no suggestion he was involved in any way with the injuries caused to Mr Seddon, his son or the two other victims.
Gaul, Wynen and Allen were arrested in the ensuing weeks following a public appeal for information and have been remanded in custody ever since.
Wynen will be sentenced on Wednesday while Gaul and Allen will have their matters mentioned on Thursday to fix a sentence date.
