Hamlyn Terrace: Plea negotiations fail with trio ordered to face trial over alleged assault of good Samaritan Rob Seddon
Three young men will face trial over the alleged assault of a “good Samaritan”, who went to the aid of a teenager trapped in a car crash, after a week of negotiations failed to resolve the case.

A “super call-over” week of negotiations has failed to fast track a case involving three young men charged over the alleged assault of a man who went to the aid of a teenager trapped in a car crash.
Rydge Liam Wynen, Reece Nathan Gaul and Kayne Allen all faced Gosford District Court this week where their respective legal representatives and Crown prosecutors undertook extensive plea negotiations.
The negotiations were part of a “super call-over” at Gosford where dozens of matters, previously listed for trial, were brought back before court to see if negotiations could resolve the matter and free up the schedule for later in the year.
The three men, all aged in their 20s, were previously arraigned on four charges including causing grievous bodily harm in company and three counts of assault occasioning actual bodily harm.
The three men were charged after emergency services were called to Skyhawk Ave, Hamlyn Terrace, about 10.15pm on August 27 2022.
Police will allege in court father-of-two Rob Seddon, his son Kyle and two other men, went to assist after hearing a car crash into a parked caravan outside Mr Seddon’s house.
A 17-year-old P-plate driver was trapped in the Toyota Corolla.
Police allege Mr Seddon, then 64, who was trained in first aid, his adult son Kyle Seddon and two other men were set upon by three males when they approached the car.
Mr Seddon was knocked unconscious and left in a critical condition when he fell backwards and smacked his head into the pavement.
He was flown to John Hunter Hospital where he underwent emergency surgery to relieve the pressure from his brain.
Mr Seddon spent months in and out of hospital following the incident and remains in a wheelchair with a significant brain injury.
Kyle Seddon and two other men were allegedly punched with one of the alleged victims, aged 21, suffering a broken nose.
The three alleged attackers fled the scene before police arrived.
The teenage driver of the Corolla underwent a breath analysis, which returned a reading of 0.025.
He was later charged with driving with a special range prescribed concentration of alcohol, using a light vehicle with not complying tyres and negligent driving.
His provisional driver’s licence was also suspended.
However there is no suggestion he was involved in any way with the injuries caused to Mr Seddon or the alleged assaults of the three other victims.
Mr Wynen, Mr Gaul and Mr Allen were later charged after police issued a public appeal for information.
Earlier this week the super call-over court heard negotiations were close to reaching an agreement.
However on Friday it became apparent to Judge Tim Gartelmann that “there are no prospects of resolution” and he set the trio down for trial on September 9.
The three men, who have all been refused bail since their arrest, remain remanded in custody.
