A man, who was banned from entering the Central Coast as part of his bail conditions, left three children distressed and traumatised after he burst into their Erina home while fleeing police and hid in a bunk bed.

Ryan Kieth Felton, of Kincumber, faced Gosford Local Court on Thursday where he pleaded guilty to failing to stop during a police pursuit, resisting arrest, stealing a car, possessing a prohibited drug and two counts each of driving while disqualified and obtaining financial advantage by deception.

An agreed set of facts state Felton filled up a car with $88 worth of fuel from the 7 Eleven service station at Green Point without paying on September 12 before stealing a Holden Commodore from a house at Springfield on September 25.

The facts state a week later Felton — who has a prominent swastika tattoo on the front of his neck — used a personal cheque to purchase a second hand GSX 1000 motorcycle on October 2.

Felton contacted the seller via Facebook and the victim recognised him because he had bought another motorcycle from him six months earlier with cash.

Felton asked if the victim would accept a cheque for $6000 and the seller said he would prefer a bank cheque but “reluctantly” agreed because “he had dealt with the accused in the past with no issues”.

However a few days later the victim looked at his account online and found the cheque had been rejected.

He contacted police who discovered the cheque was from an ANZ cheque book stolen during a break and enter at Pickets Valley a month earlier.

Felton was arrested on October 19 at Green Point and charged with possessing 0.23g of methamphetamine which he had in his pocket.

He was later released on bail pending further investigations with one of the conditions he not enter the Central Coast.

Shortly before 11pm on December 2 police travelling in an unmarked car along Henry Parry Dr at Gosford noticed a Toyota hatchback come up behind them “well above the 60km/h speed limit”.

Police pulled over to let the car past before activating their lights and sirens.

The facts state Felton “fishtailed” through the intersection of William St before crossing onto the wrong side of the road and colliding with a concrete bollard.

Felton swerved back onto the correct side of the road and turned left onto Wells St where he reached speeds of 120km/h before turning the car’s headlights off “in a deliberate effort for police to terminate the pursuit”.

He ran a red light at no less than 100km/h through the Central Coast Highway intersection onto Terrigal Dr before turning into Serpentine Rd and doubling back to Barralong Rd where he crashed into a power pole and got out and fled.

He jumped a number of fences and entered a house where police found him hiding in a bottom bunk pretending to be asleep before he “violently resisted” arrest.

“At the time there were three young children asleep within the residence,” the facts state.

“The accused has entered the residence where young children were asleep in the safety of their home and caused them overwhelming distress and trauma. These actions alone demonstrate the accused has a complete disregard for the safety and wellbeing of the community.”

The 32-year-old’s solicitor, leading Central Coast lawyer Brad Kernick, told the court his client indicated he would also plead guilty to a further four separate charges including possessing a weapon, destroying property, affray and assault occasioning actual bodily harm.

Mr Kernick told the court while Felton agreed with the facts in relation to a fifth offence of “reckless wounding”, there was a disagreement with the particular charge itself, which he argued should be assault.

The court heard Felton was charged with reckless wounding a woman causing actual bodily harm on September 18 at Kincumber.

However Mr Kernick said while Felton was holding a “machete” in his hand at the time he “punched” the victim in the face, rather than hacking at her with the knife — a distinction the police prosecutor agreed with on the basis of the facts before the court.

His matter was adjourned for that charge to be finalised and was formally refused bail to reappear on February 23 for sentence on all charges.
