A magistrate has bluntly denied bail to a man accused of elbowing a police officer and breaking his nose following a domestic dispute at San Remo.

About 12.45am on Friday, October 2, Tuggerah Lakes Police officers were called to a home on Perouse Ave following reports of a domestic-related incident.

When they arrived officers spoke with 42-year-old Daniel Josip Kovac and attempted to arrest him.

A struggle ensued before Mr Kovac allegedly elbowed a male senior constable to the face.

Mr Kovac was arrested and taken to Wyong Police Station where he was charged with six offences, including assault police occasioning actual bodily harm, resist officer in execution of duty, domestic violence assault, intimidation and breaching an apprehended violence order.

He was also charged with possessing a prohibited pistol after police seized a gel blaster pistol from the scene.

The senior constable was taken to Wyong Hospital for treatment to a broken nose and facial injuries.

A second officer suffered cartilage damage to his rib and lacerations to his right arm and knee.

Mr Kovac was refused bail to appear at Wyong Local Court today where his Legal Aid solicitor told the court the 42-year-old was the primary carer of two children and he owned the home at San Remo where he was paying off the mortgage.

He said Mr Kovac worked part time for a telecommunications contractor.

“The kids are with their mother for the school holidays,” the solicitor told the court.

“He has to be at liberty to care for his children.”

The solicitor said the female complainant in the domestic violence matter was present in court and could live at another address should the magistrate consider granting Mr Kovac bail.

But Magistrate Michael Morahan quickly dismissed any likelihood of releasing him from custody.

“I’m not granting bail, the facts are extreme,” Magistrate Morahan said.

Mr Kovac was adjourned to appear via video link on October 6.
