Caleb Alipate pleads guilty to Terrigal affray while on a bond for Forresters Beach attack

Another man involved in a wild affray at Terrigal has been sentenced after pleading guilty to punching one of the victims in the stomach.

Another man involved in a wild affray outside Terrigal Beach House last October has pleaded guilty.

Sollomon Naiobah, 25, of Umina Beach, was sentenced in Gosford Local Court on Thursday after pleading guilty to one count of affray.

An agreed set of facts states Naiobah also became involved in the melee which was sparked when his co-accused Caleb Alipate left Sirens Nightclub about 9.30pm on October 23 and joined a group of people who were talking with two men outside Terrigal Beach House.

The facts state Naiobah tried to reach one victim but was pushed away by another man until he reached the second victim who he punched “with his left hand to the stomach area”.

Naiobah was sentenced to a two-year community corrections order.

He was also initially ordered to undertake 100 hours of community service but the matter was brought back to court on Thursday where the Magistrate found he was not suitable and removed the work component of the sentence.

Caleb Alipate was still on a community corrections order (CCO) for affray and reckless wounding when he became involved in a wild “melee” outside Terrigal Beach House, a court has heard.

Alipate, 21 of Blackwall, pleaded guilty to affray and breaching a CCO when he appeared at Gosford Local Court on Friday.

Magistrate Jennifer Price ordered a full pre-sentence report given the “seriousness of the previous matters” for which Alipate was still subject to a court order when he committed his latest offence.

An agreed set of facts states Alipate had just left Sirens Nightclub at 9.27pm on Saturday, October 23, when he joined a group of people outside Terrigal Beach House.

A scuffle broke out before Alipate tried to get to one of two male victims who were set upon by up to three other men.

The facts state Alipate punched one of the victims in the head with his left hand before a number of onlookers intervened, including a female who pushed him away and stood between him and the victims.

The melee started to subside before another man ran across and tried to assault the two victims again.

“The melee again commences and the group moves towards the front entrance of the Terrigal Beach House where members of the public are lining up to enter,” the facts state.

“(Alipate) attempts to get involved in the melee a number of times but is pushed away by a female who he also pushes away.”

Security and other bystanders intervened and the fight dispersed with Alipate and his co-accuseds leaving the scene.

Alipate was adjourned to face sentence on June 17.

It comes after Alipate was sentenced to a CCO for two years and ordered to perform 350 hours of community service work for another affray at Forresters Beach in November 2018.

The court heard that incident was sparked by an argument between two young men linked to rival rugby clubs at Woy Woy and Terrigal the night before.

After a flurry of text messages one of the men demanded the other attend a 16th birthday party at Forresters Beach the next day “to fight”.

The other man made it clear he would not be there but the next night up to 20 men, including Alipate, arrived at the party and “called out guests at the party to come and fight”, the facts state.

The facts state when the group arrived several fights broke out with terrified teenage girls screaming and running inside the house to hide.

Alipate and another man were the only two charged in relation to the incident.

Alipate initially pleaded not guilty to affray, being armed with intent, destroying property, reckless wounding and six counts of assault occasioning actual bodily harm.

However after a three-day hearing he pleaded guilty on November 5, 2019 to affray and reckless wounding with the other charges withdrawn and dismissed.
