A Bandidos bikie has had his bail varied so he can associate with other bikies after a magistrate found his remaining alleged drug supply charge had nothing to do with his membership of an outlaw motorcycle gang.
Joshua Hugh Deane, of The Entrance North, faced Wyong Local Court on Tuesday charged with allegedly supplying a prohibited drug.
The court heard the 38-year-old was granted bail in the Supreme Court on December 9 after also being charged with robbery in company.
One of his strict bail conditions was a non-association order preventing him from having contact “in any way including via a third party any persons who he knows or suspects is a member, former member or associate of the Bandidos Motorcycle Club”.
Deane faced Wyong Local Court in February where his solicitor Anthony Tashman successfully sought an earlier variation to have the non-association order relaxed so Deane could have contact with his father, who the court heard was a former Bandidos member who retired from the club in 2014.
On Tuesday Mr Tashman sought yet another variation that the non-association order be lifted all together because the robbery in company charge was withdrawn.
The court heard Mr Deane had been in company with another Bandidos member when they allegedly robbed a third member of the same gang.
However this charge was withdrawn and dismissed on March 21.
Mr Tashman posed for a photograph outside court with his client and another man, which was posted on his legal firm’s Facebook page later that day boasting about the “victory”.
“Charge: Robbery In Company,” the post on Tashman Lawyers’ Facebook page states.
“MAXIMUM IMPRISONMENT: 20 YEARS! However, BYE BYE CHARGE! WITHDRAWN!”
Magistrate Kirralee Perry said the remaining charge before the court was the “deemed supply” of 74g of cocaine, which Deane was allegedly found in possession of while sitting in a car.
Ms Perry said there was “no suggestion it was associated with any member of the Bandidos gang” and “on that basis” she granted the further bail variation.
In doing so Ms Perry deleted the conditions that Deane not have any contact with his former co-accused or the alleged victim, that he not associate with any past or present member of the Bandidos and that it was no longer required for two acceptable people to post $50,000 cash surety.
Charge sheets allege Deane was found in possession of the cocaine in a car at Long Jetty on September 30.
He is yet to enter a plea in relation to that charge and the matter was adjourned to April 18.
