Hayden Todkill: man charged with attempted murder bailed

A man charged with attempted murder following an alleged brawl sparked by a spilt drink has been granted bail

A man charged with attempted murder has been granted bail at the ACT Magistrates Court by Magistrate James Lawton.

Hayden Ashley Ryan Todkill, 25, made a bid for bail on Tuesday which was opposed by the prosecution.

Mr Todkill’s lawyer Jacob Robertson told the court self defence would be a factor for the jury to consider during the trial.

Mr Todkill pleaded not guilty to attempted murder and intentionally inflicting grievous bodily harm when he first appeared at the ACT Magistrates court on March 11.

According to the statement of facts tendered to the court Mr Todkill attended a birthday celebration for the complainant and his sister on board the Canberra Party Boat on March 5 from 3pm.

The documents allege between 5.15pm and 5:30pm a woman on board the boat slapped a male attendee, and accusing him of spilling a drink on her.

The man allegedly said to the woman “you b***h, what was that for” and another man told the woman “you have the wrong person”.

At 5.40pm the boat allegedly docked early due to passengers becoming disorderly, and the party moved to The Dock Restaurant and Bar.

Court documents allege at The Dock Mr Todkill approached the man who had been slapped and said “do we have a problem”.

The man allegedly responded saying words to the effect of “I don't know, do we”.

Mr Todkill allegedly said: “Let‘s go outside.”

Mr Todkill and the man then exited the Dock onto Eastlake Parade and police allege Mr Todkill punched the man with his right fist immediately after leaving the venue.

The man allegedly punched Mr Todkill in the face causing him to fall down to the ground.

Police allege as Mr Todkill fell he grabbed the man by his collar and took the man to the ground with him.

The brawl between the two men continued in the presence of several cruise passengers until the complainant allegedly attempted to break up the fight.

The statement of facts allege the complainant leaned forward and approached the defendant from behind, wrapping his arm around Mr Todkill’s neck and pulling him away from the man.

This allegedly caused Mr Todkill to fall onto the ground, but he soon stood up and was ushered away by the complainant.

Mr Todkill allegedly began to walk away from the scene towards Eastlake Parade however the complainant and several other cruise passengers followed him.

Court documents allege at this point Mr Todkill pulled out a knife that had been concealed in his clothes and stabbed the complainant in the torso.

The complainant allegedly punched Mr Todkill in the head before the defendant stabbed him five more times.

It is alleged the complainant’s sister performed first aid on her brother before he was transported to Canberra Hospital where he underwent emergency surgery and was placed into an induced coma.
