A heavily tattooed, fully patched member of the Comanchero outlaw bikie gang – who lives at home with his mum – will be able to have a glass of wine with her on the couch after a judge relaxed his bail conditions.
Zachary John Robb, 24, appeared in Canberra Magistrates Court on Thursday charged with affray, which he allegedly committed just days into a suspended sentence.
Robb’s legal team argued the ban on him drinking alcohol meant he would end up on the wrong side of the law “were he to be enjoying a glass of wine with his partner or his mother”.
Prosecutors unsuccessfully opposed Robb’s bail conditions being relaxed, arguing it posed a risk of reoffending, with the current allegations of affray having taken place at 4.30am on a Sunday morning near a nightclub.
Court records reveal Robb’s involvement with the local chapter of the Comanchero, some of which he has documented on social media.
Magistrate Glenn Theakston granted the bail variation, and also revoked a condition that Robb not associate with a list of fellow Comanchero bikies, some of whom he worked alongside.
Mr Theakston also revoked Robb’s curfew, which Robb’s lawyer said resulted in the people he lived with being regularly woken late at night when authorities knocked on the door to make sure he was home.
Robb’s bail conditions mean he is still banned from being within 100m of licensed venues, and can’t be drunk in public.
Robb will return to court for a hearing in February.
