The owner of a Bowral organic store at the centre of a fierce anti-mask debate has had a charge against him dropped.

Mark Julius Kleeberg, 63, was listed to appear in Moss Vale Local Court on Tuesday on five charges of not complying with public health orders and resisting police.

The Organic Store was thrust into the spotlight on July 1, when Mr Kleeberg and his wife were arrested for allegedly not complying with public health orders by not wearing a face mask inside their store.

The violent arrest was captured by a customer and shows Mr Kleeberg struggling with police and shouting before being brought to the ground by three officers.

The shocking video went viral on social media, where it sparked a fiery debate about public health orders and police enforcement.

Mr Kleeberg was charged with assaulting a police officer, resisting a police officer, inciting to resist a police officer, not wearing a fitted face mask and not complying with a noticed direction regarding spitting.

He was not required to appear in person in court on Tuesday but the court heard the charge of inciting to resist a police officer had been withdrawn by police. Mr Kleeberg did not enter pleas to the other four charges, although he has been ordered to do so on his next court date on September 22.

His wife Victoria Kleeberg, 62, who is a former nurse and midwife, will appear at Moss Vale Local Court on August 17 with a 43-year-old employee on charges of defying public health orders.

Mrs Kleeberg was charged with two counts of hindering police in the execution of their duty and failing to provide a name and address. She was also directed to attend court for failing to wear a fitted face mask.

The store employee was ordered to appear in court for failing to wear a face mask on business premises and not providing her name and address.

The arrests have become a rallying point for those who believe the public health orders aren’t in the best interest of the community.

Mr and Mrs Kleeberg have been vocal in their opposition to mask enforcement and stated the arrests were “without due cause”.

Signs outside The Organic Store ask customers not to enter if they have been vaccinated and forbids wearing masks inside for “hygienic reasons”.

The owners of The Organic Store had previously started a GoFundMe campaign to raise funds for small businesses affected by public health order enforcement. The campaign was shut down by GoFundMe for allegedly breaching their terms of use, but the business Instagram page continues to ask supporters to donate directly to their bank account.
