Peter Graham admits breaching AVO in neighbourhood dispute

His two neighbours already had AVOs against him, but that didn‘t stop Peter Graham shouting out the window and shaping up when he saw them near his home.

A Goulburn man threatened his neighbours yelling “I’ll stomp on ya head, I’ll f**k ya up” while dancing around them as they were trying to move furniture.

Peter Cameron Christopher Graham, 34, faced court in Goulburn on March 9 on charges of breaching two apprehended violence orders (AVOs) which were in place to protect his neighbours from him.

He pleaded guilty to both offences.

On November 9, 2020, Graham became agitated when he saw his two neighbours moving furniture into a vehicle parked in the shared driveway, court documents state.

“Stop looking through the f****ing windows,” he shouted repeatedly, according to court documents.

When both men ignored him and continued on with the packing, he became aggressive and started threatening the men. He was shouting obscenities as he walked out of the house.

Magistrate Geraldine Beattie said Graham was starting a fight over nothing.

“You become agitated about what you think your neighbours are doing. They weren’t doing what you think they were doing,” she said.

According to one of the victims, Graham came right up to him and clenched his fists.

“Come on c**t, I’ll have ya. I’ll stomp on ya head. I’ll f**k ya up,” he shouted in the victim’s face, court documents state.

When the victim told him to “f**k off”, Graham continued to dance around as if wanting to fight, according to court documents.

Eventually, one of the victims responded to the repeated threats by picking up an iron bar and bashing the door of Graham’s house, causing minor damage.

While the fight wasn’t physical, Magistrate Beattie accepted Graham’s behaviour was aggressive and threatening to the two victims.

The victims both had AVOs against Graham which had been put into effect the month before the incident, which he breached when he approached his neighbours.

Graham’s lawyer argued the fight was a culmination of smaller arguments between the neighbours.

“This has been an ongoing tension between Mr Graham and his neighbours, escalating to this day,” he said.

“Ultimately it’s in the context of a neighbourhood dispute where there was no violence.”

Mr Graham’s lawyer blamed drug use for the violent outburst and said his client had “turned a corner” since then.

Magistrate Beattie noted a supervised rehabilitation framework would be more beneficial to Graham and sentenced him to two community corrections orders, one for 18 months and one for nine months.

“This is your last chance. Things are positive, stick with that,” she said.
