Two men have fronted court after being charged with an alleged assault in Tahmoor that left a man in an induced coma.
About 4.15am on December 27, emergency services were called to a carpark in Thirlmere Way, Tahmoor, following reports of an assault.
On arrival, police located a 20-year-old man with serious head and facial injuries. He was taken to Liverpool Hospital, where he was placed in an induced coma, but he has since been released.
Officers attached to Camden Police Area Command established a crime scene and commenced an investigation into the circumstances surrounding the alleged assault. A small hatchback, observed at the scene, was later found burnt out in a nearby carpark.
Matthew Dean Toovey, 26, faced Campbelltown Local Court on Friday after he was charged with assault occasioning actual bodily harm in company of other and dishonestly for gain damage property by fire/explosive.
His lawyer, Sarah Kermode, applied for bail on his behalf.
The police prosecutor opposed bail citing concerns around the safety of the alleged victim, and Toovey’s criminal record.
He said the alleged victim and the co-accused went to a house to party after being refused entry to a registered club.
The prosecutor said they will allege that the victim left the house after an argument and the two accused followed in a car and “seriously assaulted and viscously attacked the victim”.
He said they will also allege that two men then burnt the car and clothes to “avoid detection”.
Ms Kermode said Mr Toovey has been on bail before and complied with the conditions on each occasion.
“He currently lives at home with his mother and father. He has just started working full time,” Ms Kermode said.
“We say they [concerns over bail] can be mitigated by fairly strict conditions.”
Magistrate Trevor Khan granted bail with multiple conditions including a curfew, mandatory reporting to Campbelltown Police Station, and an order to not contact or approach the alleged victim or witnesses.
He noted that the alleged assault was “serious” and had left the victim in an induced coma for seven days.
Jakob Wiles Ronald, also aged 26, also appeared at Campbelltown Local Court charged with assault occasioning actual bodily harm in company of other(s) and dishonestly for gain damage property by fire/explosive.
The Lumeah man did not make an application for bail.
Both men are due to face Picton Local Court on March 2.
Wiles was also charged with assault occasioning actual bodily harm for a separate offence in January. That matter returns to Campbelltown Court on February 28.
