A Goulburn man has asked for internet access as part of his bail conditions despite being charged with online child abuse material of his own daughter.

The 35-year-old did not appear at Goulburn Local Court for his matter on Wednesday when seeking a bail variation.

He was previously charged on January 29 for using a carriage service to transmit /make available / publish / distribute / advertise / promote child abuse material.

Magistrate Geraldine Beattie called the matter a “very strong prosecution case.”

“It involves the defendant’s 11-year-old daughter subject to some material located and sent to a person through the internet,” Magistrate Beattie said.

Now the man has asked for a variation on his bail conditions, involving the use of the internet.

The man’s lawyer requested that he not be allowed to go within 300 metres of the victim instead of 1km.

He also requested the 8pm curfew to be amended to 9pm, so the man can attend his Alcohol Anonymous sessions, which finish at 8.30pm.

And lastly, that he be able to use the internet for mental health services relating to child abuse charges, as well as for communication with his lawyer.

In regards to the last point, Magistrate posed the question of how a condition like that could be policed.

“Conditions are notoriously difficult for police if this is to be put into place,” Magistrate Beattie said.

“I understand the role internet plays in our society, more so during Covid.”

“However this involves a sexualised conversation about his daughter and photos of his daughter.”

“The bail conditions were imposed to protect the community for offences of that nature.”

Magistrate Beattie deemed it “not appropriate” to make the internet bail condition, but granted everything else.

The man’s matter was adjourned to April 27.
