Former Chisholm Ross Centre nurse Anthony Estilo has sentence reduced after attempted rape

A former mental health nurse has successfully appealed the severity of his sentence after being jailed for trying to have sex with a woman after her 19th birthday party.

The sentence for former mental health nurse Anthony Estilo, who was jailed for trying to have sex with a woman after her after 19th birthday party, has been halved.

The 31-year-old man, who worked at Chisholm Ross Centre mental health facility, appeared via audio-visual link for his sentence appeal at Goulburn District Court on Tuesday.

He pleaded guilty on September 15 to attempting sexual intercourse without consent and sexually touching another person without consent.

The Goulburn resident was then given an aggregate sentence of 24 months in jail, with a non-parole period of 15 months, on November 24, 2021.

In a police fact sheet tendered to the court, Estilo met the teenager through a mutual friend at his house, a few days before her 19th birthday party in late January last year.

Facts state the teen then invited Estilo to her party at the Quest Hotel at Goulburn, where the victim refused a dare as part of a drinking game to have Estilo lick icing off her body.

Once the party ended at about 2am, Estilo offered the victim his help to clean the place.

Court documents state he pulled her down to sit with him on the couch, when she began to fall asleep and he took her into the bedroom and started kissing her and licking her neck and body, even after she said no and turned away.

Despite her continued attempts to push Estilo away, the facts state the victim fell asleep and woke up to the sound of him unwrapping a condom, and her shorts and underpants off.

He then placed the condom on before rubbing his penis on the teen’s vagina, court documents state.

According to the court documents, she then rolled on her side to prevent him from doing anything further and asked him to leave.

On Tuesday Estilo’s lawyer, Matthew Adam, argued that he had expressed remorse over his crimes and an intensive corrections order would be fitting.

“He understands he’s lost the right to work as a nurse and is considering to work in the food industry, having worked as a cook in the Philippines,” Mr Adam said.

Mr Adam also suggested in a previous court date that if Estilo gets a non-custodial sentence he could live with his brother in Sydney, who along with some other family members, previously gave references to the court about Estilo being a “devoted family member”.

However Crown prosecutor Nicole Johnson said although he had expressed remorse, “specific deterrence is still required”.

“In the sentencing assessment report, he went on to say that even though she said no, it wasn’t registering for him,” Ms Johnson said.

In a previous court appearance, Magistrate Geraldine Beattie described the impact Estilo’s crimes had on the victim, as expressed in the victim impact statement.

“This has impacted on her mental health, her life, her ability to make friends, she’s now got anxiety and lost her job,” Magistrate Beattie said.

“It’s a very significant custodial sentence.”

This week, Judge Mark Williams handed Estilo an 11-month aggregate sentence served by intensive corrections order starting from Tuesday.

Estilo is to undertake 200 hours of community service and report to Parramatta community corrections office by February 7.
