After a car accident: your rights & rules

A young woman blew almost three times the legal alcohol limit after she crashed into another car in a Bowral roundabout and then drove off into a gutter.

Emma Bond, 24, appeared in Moss Vale Local Court on Tuesday after pleading guilty to mid-range drink driving and possession of a prohibited drug.

The court heard the Robertson resident had been drinking Little Fat Lamb premixed drinks with her boyfriend when the two got into an argument and she decided to drive. At around 11pm on July 11, Bond was driving along Kangaloon Rd approaching the intersection with Funston St when she mounted the concrete island, according to court documents.

The documents reveal she failed to give way to an approaching car and instead drove through the roundabout and crashed into it, causing major damage. Despite this, agreed facts show Bond sped through the roundabout and made no attempt to stop.

Witnesses told police they saw Bond’s car veer off Moss Vale Rd and hit the gutter after travelling a short distance. Police found her in the driver’s seat of the car and determined she was “slurring her words, erratic, and appeared seriously affected by alcohol”, according to the facts.

At the police station, Bond returned a reading of 0.146, which is nearly three times the legal blood alcohol level for driving.

However, her troubles weren’t over. Police discovered a clear resealable bag containing 70 grams of cannabis in the car. Bond told officers she’d bought the cannabis for personal use.

Documents show both cars had to be towed from the scene, although no one was hurt.

Bond’s lawyer told the court his client had no prior criminal offences and had shown remorse for her actions, despite having a limited memory of the incident.

“She doesn’t have a great recollection, not surprisingly, given the eventual reading,” he said.

“She acknowledges what she has done is foolish.”

The court heard Bond had participated in a traffic offenders program and is currently seeking to address her “alcohol problem”.

Magistrate Mark Douglass said more should have been done to prevent Bond from driving that night.

“She was in no condition to be on the road,” he said.

He accepted the defence’s argument Bond had made an error in judgment that wouldn’t be repeated.

“It’s a one-off, out of character,” he said.

Magistrate Douglass convicted Bond and sentenced her to a year-long conditional release order. He also fined her $600 and disqualified her from driving for three months.

The magistrate told Bond not to let her mistake hang over her head.

“You’re a good person,” he said.

“You’ve made a mistake. Don’t beat yourself up about it too much.”
