A former mental health nurse is appealing the severity of his sentence after being jailed for pulling down an intoxicated woman’s underpants and trying to have sex with her after her 19th birthday party in a Goulburn hotel.

A former mental health nurse caught pulling down an intoxicated teen's underpants and trying to have sex with her after her birthday party, has asked for a bail review leading up to an appeal of his jail sentence.

Anthony Estilo, 31, who at the time worked at mental health hospital Chisholm Ross Centre, was not present via audio-visual link for his bail review on Wednesday at Goulburn Local Court.

He had previously pleaded guilty on September 15 to attempting sexual intercourse without consent and sexually touching another person without consent.

He had previously pleaded guilty on September 15 last year to attempting sexual intercourse without consent and sexually touching another person without consent.The Goulburn resident was given an aggregate sentence of 24 months in jail, with a non-parole period of 15 months, on November 24 2021.

According to a fact sheet tendered to the court, the Goulburn resident met the teenager through a mutual friend at his house, a few days prior to her 19th birthday party in late January.

Facts state the teen then invited Estilo to her party at the Quest Hotel, where the victim refused a dare as part of a drinking game to have Estilo lick icing off her body.

Once the party ended at around 2am, Estilo offered to help the victim clean.

The court documents state he pulled her down to sit with him on the couch, when she began to fall asleep and he took her into the bedroom and started kissing her and licking her neck and body, even after she said no and turned away.

Despite her continued attempts to push Estilo away, the facts state the victim fell asleep and woke up to find he had pulled down her shorts and underpants, and was touching her vagina.

Although the victim pushed his hand away, court documents state Estilo kept touching her and kissing her on the mouth, neck and cheeks. After falling asleep again, the facts show the victim woke to the sound of the offender unwrapping a condom, which he placed on his penis before rubbing his penis on the teen’s vagina.

According to the court documents, she then rolled on her side to prevent him from doing anything further and asked him to leave.

Estilo's lawyer, Mathew Adam, said he would be asking for a community corrections order that would include the offender not being allowed into airports, given the fact he has a work visa.

Mr Adam suggested Estilo could reside with his brother, who along with some other family members, previously gave references to the court about Estilo being  a “devoted family member.”

He also mentioned this is Estilo's first time in jail and that the offender is willing to "forfeit up to $5000" in exchange for bail.However, crown prosecutor Nicole Johnson argued there was "too much of a risk" and "full time imprisonment is the only suitable outcome of the appeal."

Magistrate Beattie refused Estilo bail on the grounds that his matter is a "very significant custodial sentence."

Previously, Magistrate Beattie spoke of the seriousness of the offences, which despite the offender expressing remorse, was a "gross invasion."

“Clearly when the other party is saying no and pushing you away, and is falling asleep, she is not consenting,” Ms Beattie said.

She also refused bail because of the short time period between the bail review and his appeal.

Estilo will appear via audio-visual link at Goulburn District Court on January 31.
