A Southern Highlands man crashed his car on Monday in a high range drink driving incident, thereby breaching his strict bail conditions for another serious offence.
Matthew Vincent Milton, 36, appeared via audiovisual link at Moss Vale Local Court on Monday, after being charged for driving with a high range prescribed concentration of alcohol.
The court heard the Balaclava local was brought to the attention of police when he was in a single vehicle collision on Bendooley Street in Bowral, after having consumed a large quantity of alcohol.
According to the facts provided to the court, his blood alcohol reading was .266, just over five times the legal limit.
Magistrate Mark Douglass mentioned that by drinking alcohol, Milton had breached one of his current bail conditions for the charge of sexual touching without consent.
He also stressed that this is his fourth alcohol related charge.
“This is clearly a very serious offence,” Magistrate Douglass said.
“Getting behind the wheel at that reading is a huge and unacceptable risk to the community.
“ — And it was done on a strict bail condition of not drinking alcohol.”
Magistrate Douglass also highlighted the seriousness of the offence Milton was on bail for.
The court heard he was struggling with alcohol use and Magistrate Douglass asked for a note to be made to Justice Health that he was withdrawing from alcohol.
“A withdrawal from alcohol can be quite significant and serious,” Magistrate Douglass said to Milton.
“Please seek medical treatment when being accessed in custody.”
Milton’s bail was revoked for the matter of sexual touching without consent and he is due to appear via audiovisual link on Tuesday.
