Whalan local Charles Daryll Pagan jailed over masturbating to 14-year-old girl on a bus

A western Sydney man who touched himself while sitting and staring at a 14-year-old on a bus has been sentenced to jail over the incident.

A western Sydney man with “moderate intellect impairment” who masturbated in front of a 14-year-old girl on a public bus has been sentenced to full-time imprisonment.

Whalan local Charles Daryll Pagan, 28, faced Mt Druitt Local Court on Wednesday, when he pleaded guilty to intentionally doing a sexual act with a child between 10 to 16-years-old.

Documents tendered to the court state in late October last year, Pagan got on a bus in Glendenning and sat next to a young girl.

The young girl was returning home from school and did not know Pagan prior to this encounter.

Police facts stated Pagan placed his backpack over his lap, reached down and began to “masturbate while looking towards the victim and her skirt”.

Documents state the incident occurred on a Busways bus.

The victim noticed his stares after about five minutes when she saw his reflection in a nearby window, and could see the top half of his penis.

When her stop approached, the young girl quickly got up and had to “squish” past Pagan in order to get off. She immediately told her mother when she got home, who then reported it to the police.

The entire incident was captured on CCTV which the bus company, Busways provided to police.

A week after the incident, police attended Pagan’s residence regarding the incident, with Pagan apologising “multiple times” and “offered to say sorry for any trauma he caused”.

In court on Wednesday, Pagan’s lawyer stated his client was a man of “moderate intellect impairment” which has had an “effect on his ability to regulate his behaviour”.

Magistrate Debra Maher accepted Pagan’s genuine remorse for the offence and that it was “opportunistic” and not planned.

Daryll Pagan faced Mt Druitt Local Court on Wednesday via AVL.

“That much is obvious from his admissions to police,” she said.

However, Ms Maher pointed out how traumatised the victim was over the incident and didn’t dismiss the fear the girl held with her encounter with Pagan.

“Of course it is important to recognise the harm this caused the victim and the impact on her wellbeing,” she said.

Pagan was sentenced to a nine-month term of imprisonment, with a non-parole period of four months.

He will be eligible for release on parole on March 5.
