Shane Booth: Kings Langley man jailed over drug-fuelled rape

A man who raped a woman during a drug-fuelled encounter at his western Sydney home has been jailed.

A western Sydney man smoked ice with his mother and some friends before forcing himself on a woman who passed out in his home.

Shane Booth, 32, was sentenced to a total of four years and two months in prison on Friday after the court heard he “took advantage of the incapacity of the victim for the purpose of his sexual gratification”.

In August 2019, Booth was at his mother’s home in Kings Langley where he, his mother and others consumed the drugs ice and cannabis, according to agreed facts.

The victim took some of Booth’s drugs and eventually lost consciousness.

When she woke up, Booth was touching her breasts and vagina.

He then forced the victim’s mouth open and orally raped her.

He slapped the woman’s cheek and began to choke her, the court heard.

She lost consciousness again and woke up at daylight, before visiting a friend’s house, the police station and the hospital.

She complained of tenderness to her throat and bruising to the side of her face, the court heard.

Booth had suffered a childhood of “social disadvantage and deprivation”, the court heard, where his mother was a drug user and an alcoholic, and he drifted into a pattern of drug use at a young age.

There was a “distinct failure of the mother to provide an example of what is right and what is wrong,” Judge Robert Weber said.

The court heard he had convictions related to crimes of violence on his record.

Booth was found guilty by a jury of sexual touching without consent and sexual intercourse without consent.

He was also charged with two related charges of common assault, related to the slapping and choking.

He was sentenced to a period of two years and six months non-parole, to expire on August 3, 2022.

A western Sydney man who raped a woman during a drug-fuelled bender at his home had to be moved to another prison after inmates found out about his crime, a court has heard.

Shane Anthony Booth, 32, will be sentenced next month on charges of sexual intercourse without consent, sexual touching and common assault on a 36-year-old woman in 2019.

He faces additional charges of larceny and stealing a motor vehicle.

Booth faced Penrith District Court last week, where it was heard he had been moved from Francis Greenway Correctional Complex near Windsor to another prison after other inmates discovered the nature of his charges, prompting concerns for his safety.

According to court documents, Booth raped the woman and sexually touched her without her consent at a home in Kings Langley in August 2019.

Police documents showed the victim and a friend had visited his home the previous day where they smoked cannabis and ice.

The victim felt sick after taking the drugs and took a nap in a bedroom when she woke to find her phone and car keys missing.

Police said the woman then went outside to find her $75,000 car missing, with Booth last seen jumping over a balcony, according to court documents.

Papers further revealed, when the woman called Booth, he denied taking the car, yelling at her, “How would I know (where it is), you f***ing dog”.

The victim left the house later that day and reported the incident to Castle Hill Police.

Her car was found parked in North Parramatta the following day.

The court heard Booth had a lengthy criminal history and had been arrested by police on 50 occasions.

Evidence given to the court by his psychologist revealed that Booth had a history of drug abuse and trauma stemming from childhood.

It was heard that Booth had “expressed regret” at his behaviour”, but questions were raised by the prosecution as to whether he was remorseful for his actions.

He will face the Downing Centre District Court for sentencing in June.
