A Doonside man who was on strict bail has faced court after allegedly attacking his ex partner’s new beau in broad daylight.
Robert Leuthwaite, 36, fronted Blacktown Court via AVL on Tuesday after the alleged incident on Sunday afternoon.
The court heard it is alleged Leuthwaite attacked him while he walked home from work.
Magistrate Brian van Zuylen read from the facts, which stated, “He started punching and biting him.
“He squeezed him causing pain to the victim’s eye socket.
“It says he screamed, ‘I am going to break your neck, I am going to break your neck.’”
Leuthwaite pleaded not guilty to the charge of assault occasioning actual bodily harm.
His lawyer applied for bail stating that he needs to be able to care for his sick father and teenage daughter.
His lawyer also made note of the strictly indictable aggravated break and enter charge he is soon to face prosecution over but said this matter is completely separate.
“He is a 36 year old aboriginal male who lives at home with his mother and father. His father has stage 3 bowel cancer and he cares for his 13 year old daughter.”
He added: “The facts of this matter show he co-operated with police and ultimately this case comes down to a one-on-one version.”
Police Prosecutor Sargent Tony Fitzgerald strongly opposed bail saying Leuthwaite has a large criminal record, largely consisting of acts of violence.
“He has a long criminal record with multiple counts of violence and he is looking at a likely custodial sentence for this incident if found guilty.
“He is also on strict bail for a strictly indictable break and enter matter.”
Magistrate Brian van Zuylen refused bail.
The matter will return to the same court on March 4 for hearing.
