A serial sex pest who has twice been convicted of sexually touching women in public has had an appeal against his jail sentence quashed.
Ammon Mitiau, 27, was jailed for up to 14 months in January after he pleaded guilty to stalking and intimidating a young woman and sexually touching her without consent last year.
The Cook Islands national admitted to touching the 20-year-old woman on her genital region on the outside of her dress after he followed her into an elevator at Mt Druitt station on November 26, 2019.
Police said Mitiau had approached the woman at Blacktown station at 3pm that afternoon and followed her onto the train while he tried to engage in conversation with her.
He followed her as she exited the train at Mt Druitt before the terrifying incident unfolded.
The woman pushed him away before she raised the alarm with officers from the Police Transport Command.
Mitiau sought to appeal his sentence in Parramatta District Court on Tuesday, telling the court his offending was “not that serious”.
However, Judge Stephen Hanley slammed his behaviour.
“This young woman would have been terrified by your behaviour,” he said.
“She was confronted by someone who was intoxicated and spoke to her and followed her.
“She was placed in an extremely frightening position because of your behaviour.”
Citing a psychiatrist’s report which noted a previous diagnosis of schizophrenia, Mr Hanley said Mitiau had not shown any remorse for his behaviour.
“You have little insight into your offending behaviour and are at high risk of re-offending,” he said.
The court heard Mitiau had been convicted of a similar incident in the ACT in 2018.
Media reports show he followed a woman into a clothing store at the Canberra Centre on December 10 before touching her genitals under her pants.
His criminal record also shows convictions for stalking/intimidation and an act of indecency without consent in 2015.
Mr Hanley dismissed the man’s appeal.
“You’re fortunate this was dealt with in the local court,” he said.
“The sentences imposed were reasonable.”
Mitiau will be deported from the country at the conclusion of his 10-month non-parole period in November.
