An Australian man who allegedly slapped a German mum during a fight in a pool at a luxury Balinese resort says he will lose his home while in jail on remand.
Prosecutors have demanded a six month jail term for western Sydney man Ali Shahrouk over an incident at the $950 a night Apurva Kempinski resort in Nusa Dua.
He allegedly “slapped” German tourist Christin Tiller during an argument at the cliff top five star resort.
However, a witness told the court Mr Shahrouk’s hand was clenched when he approached Ms Tiller, whose medical records indicated she had bruising to her nose and jaw.
Mr Shahrouk, of Auburn, asked to be released during a hearing in Bali’s Denpasar District Court on Tuesday, saying he will lose his home because his business has shut down while he was in jail on remand.
“I have family in Australia that should be supported,” he told the court.
“My house is now seized by the bank as my business has (shut) down, and my kids (need to) undergo surgery in Australia, and I hope that I can accompany him. I plead to the panel of judges to give a light sentence.”
Mr Shahrouk, 38, was charged with assault under article 351, subsection one of Indonesia’s criminal code, which relates to incidents with minor injuries.
The court was told that Ms Miller was taken to the private BIMC Hospital in Nusa Dua.
Doctors reported bruising to her nose and jaw, which stopped her from working for several days, the court heard.
“In the examination to witness Christin Steinrode Tiller, it was found bruises were caused by blunt force. The bruises can cause an infection and disease that hampered the victim from doing her job temporarily,” prosecutor Made Hendra Pranata told the court, according to a translation.
The incident happened shortly at 1.30pm on January 29 this year at the up-market resort, which boasts an open air theatre and a restaurant underneath an aquarium.
There was a dispute between parents about how a child was pushed down a slide which led to a verbal argument.
Ms Miller allegedly scratched Mr Shahrouk’s chest and he retaliated by striking her, with a witness saying his fist was clenched.
A lifeguard separated the pair and called security.
Ms Miller has since returned home to Germany, while Mr Shahrouk has remained in custody.
He was due to return to court for sentencing on May 20.
