A young chippy’s night out ended in a mess after he urinated inside a Hobart McDonald’s – with a magistrate quick to say why he was not McHappy about the man’s excuse.

At about 5.50am on March 5 this year, Daniel Christopher Lucas was inside the Argyle St McDonald’s when he took his penis out of his pants and urinated inside the restaurant, Hobart Magistrates Court was told.

Police prosecutor Melanie Baker told the court that after Lucas had urinated near people who were trying to eat, he was “accosted” by another customer.

Police were called where the pair were separated.

Lucas was charged with and pleaded guilty to a count of commit a nuisance.

Magistrate Chris Webster said police could have hit Lucas with a more severe charge.

“Urinating in a public place is going into the street … not whipping it out in Mcdonald’s,” Mr Webster said.

When asked to tell the court about what had led to the incident, Lucas, who the court heard was an apprentice carpenter, said he had a “few drinks” on the night, but that he believed he had been drugged.

“I can’t remember anything from 3am … A few different things – I can’t remember being in McDonald’s,” he said.

Mr Webster told Lucas he “probably drank too much”.

“(That is) one hundred per cent, very possible,” Lucas said.

“I will take 100 per cent responsibility for it.”

Mr Webster noted there were toilets in McDonald’s restaurants.

“Police could have charged you with more serious charges … you exposed yourself in front of others,” he said.

Lucas was fined $300.

No conviction was recorded.
