A young man who sexually assaulted a 12-year-old girl aboard a Seaford train had been convicted of aggravated indecent assault three years before, a court has heard.
Dylan Nicholas Lloyd, 23, faced the Supreme Court on Monday as prosecution continued its argument he remain in prison after his impending jail term ends – if he is deemed incapable of or unwilling to control his sexual impulses.
Lloyd, of Aldinga Beach, previously pleaded guilty to one count of indecent assault, one count of unlawful sexual intercourse with a person under the age of 14 years, one count of communicating to make a child amenable to sexual activity, and one count sexual abuse of a child.
However, for the first time on Monday, the court also heard he was serving a two-year good behaviour bond at the time of the Seaford assault after an indecent assault in 2021 – for which he was sentenced in 2023.
Lloyd pleaded guilty to breaching that bond in January 2024, after CCTV captured him kissing and sexually assaulting a young girl – unknown to him – on an Adelaide-bound train.
Prosecutors are seeking to have Lloyd be dealt with under Section 57 of the Sentencing Act, which allows for the indefinite detention of sex offenders.
That detention ends only when, and if, two mental health experts agree the offender has demonstrated a willingness to control themselves in public.
“The victim describes that she froze … she was in a complete state of panic – she didn’t quite know what to do,” Sergeant Sally Francis previously alleged.
“She was trying to get eye contact with other passengers on the train.”
During his first appearance, the Christies Beach Magistrates Court heard CCTV on the train had captured Lloyd kissing and putting his arm around the child, before following her “very closely” as she exited at the Marion station.
A member of the public then helped the upset girl and contacted police.
Lloyd was linked to the incident through his Metrocard, which he used to catch another train.
Police also allege they found clothes, a bag and shoes at his home consistent with what was depicted on the CCTV.
On Monday, prosecutor Talia Costi told the court she “maintained” prosecution’s Section 57 application and requested an adjournment to allow for the return of an indemnity report.
Ms Costi told Justice Sandi McDonald that victim impact statements for “two youths” would be prepared.
“This is no more than a thought bubble, but is there any utility in listening to the victim impact statements sooner rather than later?” Justice McDonald asked?
“I believe there would be,” Ms Costi replied. “I’ll make those inquiries in the next fortnight.”
Lloyd was remanded into custody and will return to the Supreme Court in October.
