An Adelaide doctor claims to have suffered harassment, intimidation and threats after reporting a colleague for allegedly having an affair with a patient.
The doctor who wants to remain anonymous says it has taken a physical and mental health toll as police were called and complaints allegedly made in retaliation were investigated by medical authorities — and dismissed.
The doctor says mandatory reporting is a cornerstone of medical ethics and professional conduct, ensuring patient safety and maintaining public trust in healthcare.
“However, the experience … highlights the devastating personal and professional consequences that can follow when a vexatious complaint arises after a mandatory report,” the doctor states.
The doctor says healthcare professionals need to proceed carefully and thoughtfully if reporting a colleague.
The doctor reported a colleague to the Medical Board after learning the colleague had allegedly been in a relationship with a patient — an act many consider could violate professional boundaries.
The doctor said this sparked a nightmare of “relentless harassment and retaliation.”
The doctors said the reported colleague then launched a series of complaints to regulatory bodies against the reporting doctor, including unsubstantiated allegations of harassment and workplace misconduct.
The doctor said there were also “threats and intimidation outside the workplace.”
The toll included anxiety, stress and deteriorating health as well as a financial burden dealing with legal and administrative processes as complaints were investigated.
“This experience underscores a harsh reality: while mandatory reporting is designed to protect patients and uphold professional integrity, it can also expose doctors to unexpected risks,” the doctor said.
The doctor advises other health professionals in a similar situation to seek confidential advice from trusted colleagues as well as legal advice, and to “document everything.”
“Prepare for possible retaliation,” the doctor advises. “Be prepared for potential backlash and have a support system.
“Seek professional support. Engage with medical defence organisations, legal advisers and mental health professionals to navigate the challenges that may follow.
“This story is a sobering reminder of how fulfilling ethical duties can sometimes lead to unintended consequences.”
Complaints to the regulatory body the Australian Health Practitioner Regulation Agency can lead to restrictions or suspension of registration.
