Man who breached DV order by sitting outside former partner’s house given jail sentence

A man who has breached domestic violence orders a dozen times was given a jail sentence for sitting outside his former partner’s house.

Sitting outside his former partner’s house has cost a man jail time.

It was the 12th time the man, who cannot be named, had breached a domestic violence order in the past five years.

Police were called to his former partner’s Bray Park address Tuesday morning where he was found sitting outside.

But a domestic violence order against him banned the man from being within 100m of the house.

The order was less than two months old after being put in place in July.

He was arrested and taken to the police watch house.

The 47-year-old man pleaded guilty at Pine Rivers Magistrates Court to breaching the domestic violence order.

The man’s lawyer Andrew Ferrett told the court his client and the woman had three sons together.

He said he wanted to see one of their sons who he believed had started using drugs.

The man was already on a suspended jail sentence that breaching the domestic violence order breached.

Mr Ferrett said the man knew that sentence would be activated but called for him to be immediately released on parole.

“I’m not shying away from imprisonment,” Mr Ferrett said.

The court heard the man was currently unemployed but had a job interview lined up on Wednesday.

Magistrate Melanie Ho told the man he needed to work out how to communicate with his former partner better.

“Your sons need their father,” she said.

“You’re going to have to be a bit more savvy in the head with how you deal with the aggrieved.

“If you go and see your kids it is not her that will go to jail.”

He was sentenced to five months jail and released on parole immediately.
