A woman arrested after she threw a television and spat at police when already on bail for a violent offences has been released again because she needs to care for her children.

Michelle Jane Marsh wept as Magistrate Annette Sinclair told her she was close to remaining locked up over the incident in Woolloomooloo just before 11pm on Friday night.

The court heard Marsh had to be tasered after she spat at and threw a television at police who came to her home to investigate stolen property.

“I hope you appreciate you have gone within a hair’s breadth of being refused bail,” Magistrate Sinclair told Marsh in Parramatta Bail Court today.

According to police documents, Marsh verbally abused the officers from Kings Cross Local Area Command before she allegedly spat at a male senior constable.

When police tried to arrest the mother of two, she allegedly slammed the door to her apartment, cutting a female officer’s hand, before throwing a television at the officers.

Marsh then allegedly charged at the male officer who had to taser her.

She was charged with one count of assaulting police and another of resisting police.

Her taxpayer funded Legal Aid lawyer told the court Marsh needed to be granted bail so she could look after her 10-year-old son and five-year-old daughter.

“To refuse bail would cause extreme hardship to the children,” the Legal Aid lawyer told the court.

The police prosecutor argued against granting bail and told the court the police were injured during the incident while trying to do their job and that a prison sentence was likely if Marsh was convicted.

Magistrate Sinclair accepted Marsh’s criminal record was “limited”.

This included two matters from 2016 and 2018 that were dealt with by way of fines.

But the court heard Marsh is already on bail for charges related to “matters of violence” — the details of which were not revealed — when she allegedly attacked the police.

In granting bail, Magistrate Sinclair said a jail sentence was not guaranteed and that the care and needs of the children were an issue that needed to be balanced with protecting the community.

Marsh was ordered to report to Kings Cross Police Station on Tuesday, Thursday and Saturday between 8am and 8pm.

She will face the Downing Centre Local Court on March 12.
